Response to CN-01 Third Adequacy Issues - June 6, 2011 <br />3. Grade Pre-existing access roads; <br />4. Install appropriate storm water management structures; <br />5. Excavate the collapsed Portal at May Day #1 level and establish a <br />stable high wall and mine bench at the May Day #1 level; <br />6. Remove soil, rock and minim related debris from the drainage <br />channel of Little Deadwood Gulch at the Chief Portal and May Day <br />#2 level; <br />7. Take corrective measures as necessary to comply with enforcement <br />actions issued by others agencies, with written approval from the <br />Division; and, <br />8. Consolidate and/or remove ore stockpiled on the benches and on the <br />floor of the May Day No. 1 stope (referenced in the order resolving <br />NOV No. MV-2009-035). <br />b. For the Period beginning after the receipt of first quarter ground water <br />testing results to the receipt of second quarter ground water testing results <br />(assuming water quality and testing results are deemed acceptable).- <br />1._ Retrofit and test the mill, limited to the materials described in a.8. <br />above; and, <br />2. Construct, if necessary, the augmentation ponds <br />C. For the Period beginning after the receipt of second quarter ground water <br />testing results, if the same were found to show compliance with all applicable <br />regulations, Wildcat Mining will be permitted to engage in full and complete <br />mining activities which may include, but will not be limited to the following: <br />1. Commission the mill; <br />2. Conduct milling optimization; <br />3. Production at May Day 91 level; <br />4. Exploration; <br />5. Production expansion; and, <br />6.
