Response to CN-01 Third Adequacy Issues - June 6, 2011 <br />Please revise Exhibit D, Mining Plan, to acknowledge the permit conditions imposed by <br />paragraph (3)(b) of the Joint Stipulation, and the requirements of the Act and Rules, as clarified <br />in this adequacy item. <br />Response #14 <br />Wildcat Mining is submitting a revised Exhibit D, Mining Plan, modified to acknowledge <br />the permit conditions imposed by paragraph (3)(b) of the Joint Stipulations, and the <br />requirements of the Act and Rules, as clarified in the Third Adequacy letter. See <br />Attachment G. <br />Wildcat Mining proposes the following clarification or modification to the list of activities <br />included in Adequacy Issue Nos 14.a. and 14.b. In response to Adequacy Issue No 28, <br />Wildcat Mining proposes to transport a drill rig to the site to drill two wells for the purpose <br />of round water quality sampling, monitoring, and as a point of compliance The two wells <br />are intended to provide data to supplement the body of data accumulated by Wildcat <br />Mining over the last five calendar quarters from five different testing locations, including <br />on the Little Deadwood Creek upstream and downstream of the Site; on the La Plata River <br />upstream and downstream of the Site; at the Idaho spring; and, during the fifth quarter, at <br />the downstream wetlands. Provisionally, the location of the two monitoring wells will be at <br />the Idaho Spring and May Day No 2 portal Wildcat Mining proposes that the wells will <br />be drilled to a depth at or slightly below the depth of the La Plata River and that ground <br />water sampling would commence immediately Wildcat Mining's current water quality <br />testing results indicate that the character of the ground and surface water is identical <br />Wildcat Mining believes that due to fracture flows through the mine the ground water is <br />simply the surface water dropping into the mine fracture system Wildcat Mining's water <br />duality test results to date evidences any actionable contamination from the site Wildcat <br />Mining proposes that ground water sampling would occur for at least two quarters and, <br />pending the results of the water quality test results, full mining activity would be allowed <br />following the second quarter with the understanding that the wells would remain in <br />operation for monitoring purposes, until further agreement of the parties <br />Consistent with the foregoing, Wildcat Mining requests modification of the lists of activities <br />on Adequacy Issue Nos. 14.a and 14.b. such that the following activities will be permitted <br />during the following time frames: <br />a. For the period beginning immediately until the receipt of the first quarter <br />testing results from the two well sites; <br />1. Mobilize a rig to drill two identified wells; <br />2.
