Fourth Adequacy Letter, Amended CN-01 15 <br />May Day Idaho Mine Complex <br />• The Storm Water Management Plan, required under Rule 6.4.21(10)(b), was <br />submitted as Attachment T-4 of Exhibit T of Attachment G-1 of Attachment G. <br />Pursuant to Rule 6.4.21(10)(b), the Storm Water Management Plan should be <br />submitted under Exhibit U, Environmental Protection Plan, and not Exhibit T. <br />Exhibit T is reserved for Permanent Man-Made Structures, pursuant to Rule <br />6.4.20. <br />• The Surface Water Quality Data, required under Rule 6.4.21(11)(b), was <br />submitted as Attachment T-5 of Exhibit T of Attachment G-2 of Attachment G. <br />Pursuant to Rule 6.4.21(11)(b), such data should be submitted under Exhibit U <br />and not Exhibit T. <br />7. On April 18, 2011, the Division received the Applicant's response to adequacy issues <br />previously raised by the Division for CN-01. The Applicant's response consisted of 431 <br />pages received at the Division's office in Denver, and 48 pages received at the Division's <br />office in Durango. In the future, please avoid splitting the submitted documents <br />between the various offices of the Division. Please submit the entire package of <br />application materials to the Division's office in Denver. <br />Pursuant to paragraph (3)(f) of the Joint Stipulation, the Applicant has agreed to address the <br />Division's adequacy issues at least two weeks prior to the decision date. Therefore, please <br />respond to the issues identified in this fourth adequacy letter, and in the two attached staff <br />memorandums from Tim Cazier, and in the Division's third adequacy letter, no later than June <br />7, 2011.
