Fourth Adequacy Letter, Amended CN-01 I 4 <br />May Day Idaho Mine Complex <br />Therefore, the Applicant has affected the pre-law highwall and has incurred full <br />reclamation liability for the structure. <br />The access road to the Incas Mine is perched at the crest of the highwall. <br />Please provide a geotechnical evaluation for the portion of the access road to the Incas <br />Mine, undermined by construction of the Chief Portal. The geotechnical evaluation shall <br />address the applicable requirements of Rules 6.5(1), (2) and (3). <br />5. In the Division's third adequacy letter, under adequacy number 16, the Division <br />indicated review of the proposed Storm Water Management Plan (SWMP) was not yet <br />completed. The Division is still reviewing the proposed SWMP, which was amended in <br />response to adequacy issues previously raised by the Division. <br />6. In the Division's third adequacy letter, under adequacy item number 41, the Division <br />indicated the documents received on April 18, 2011, did not provide an Attachment K. <br />Such statement was in error. The Division has noted the amended CN-01 included an <br />Attachment K, which contained Exhibit U, Environmental Protection Plan. The <br />application materials submitted by the Applicant for CN-01 exceed 1,400 pages. The <br />Division would appreciate the Applicant's cooperation in organizing and managing the <br />application materials. Please simplify future submittals by avoiding the use of multiple <br />and unnecessary layers of attachments, as well as attachment names which confuse the <br />names of the Exhibits required under the Act and Rules. Examples of confusion in the <br />amended CN-01 include, but are not limited to, the following: <br />• Exhibit A, Legal Description, was located in Attachment D. <br />• Exhibit C, Pre-mining and Mining Plan Maps, was located in Attachment J. <br />• Exhibit D, Mining Plan, was located in Attachment E-1 of Attachment E. <br />• Exhibit F, Reclamation Plan Maps, was located in Attachment C. <br />• Exhibit G, Water Information, was located in Attachment H. <br />• Exhibit M, Other Permits and Licenses, was located in Attachment E-3 of <br />Attachment E. <br />• Exhibit T, Permanent Man-Made Structures, was located in Attachment I. <br />• Exhibit U, Environmental Protection Plan, was located in Attachment K. <br />• Attachment E directed the Division to Attachment E-5 for portions of Exhibit 6.5 <br />and Table 6.5-1, Chief Drainage Channel Flow Calculations. Attachment E-5 <br />contained only one table, Table T5-1, Analyte Laboratory Test, which was not <br />legible. Please submit an enlarged and legible version of Table T5-1. Please <br />clarify whether the Applicant intended to direct the Division to Table SWMP-A of <br />Attachment SWMP-2 of Attachment T-4 of Exhibit T of Attachment G-1 of <br />Attachment G for the desired hydrologic calculations. <br />NOTE: Pursuant to Rule 6.5, Exhibit 6.5 is reserved as the Geotechnical <br />Stability Exhibit. Table T5-1, Analyte Laboratory Test, appears to be <br />inappropriately placed within Exhibit 6.5.
