Commissioner Lieb, referring to Condition #11 regarding the road design, asked <br />whether that issue had been addressed in the Conditions. He said he would like to also <br />hear about re-vegetation and reclamation plans and whether those would be submitted <br />before issuance of the permit. He also wanted clarification regarding the Southern Ute <br />Tribe minor source air permit provisions, whether they had been formally adopted or <br />were still in the drafting stage, and if Weeminuche Construction would agree to adhere <br />to those regulations in their current draft form and as they changed along the way. <br />(Activated at 00:36:03) <br />Commissioner Hotter explained that the Commissioners jurisdiction is limited, but what <br />they could take into consideration was the issue of whether the project was compatible <br />with surrounding land uses. She said that she understood the importance of taking into <br />consideration existing businesses and noted that the area has been classified as light <br />industrial, so there will be truck traffic. However, the Commissioners could address the <br />issue of what could be done to minimize or mitigate the impact this project will have on <br />traffic flow. She said that, in addition to the stated Conditions in the Staff report, she <br />wanted to know how they would be enforced. (Activated at 00:39:02) <br />Commissioner Hotter asked the agent/applicant to come forward and address the <br />Commissioners' questions. <br />Mike Russell, Russell Planning and Engineering, addressed the issue of traffic and <br />trucks hauling gravel over the designated route. He said there would be a maximum of <br />242 round trips a day. He said that the Bechtel Company road design comments were <br />included in their initial plan set and that they have now addressed those concerns. <br />(Activated at 00:41:46) <br />Commissioner White asked agent/applicants to address the matter of a proposed <br />concrete batch plant. (Activated at 00:45:56) <br />Robin Halverson, Executive Director/ Manager of Weeminuche Construction, addressed <br />the issue of reclamation, stating that the Department of Mining Resource and Safety <br />and the Department of Health (regarding pollution of air and water) are in charge of <br />regulation and enforcement, particularly in regard to reclamation which is a part of the <br />permitting process. She said there are local agents that investigate and monitor activity <br />and compliance. (Activated at 00:46:56) <br />Tom Hall, Business Manager/Controller for Weeminuche Construction, addressed the <br />issue of pollution and dust. He said that the State of Colorado is very specific regarding <br />the equipment used, how long the diesel equipment is allowed to warm-up etc. He said <br />that the State is very specific about dust control. He said his company would shut down <br />the mining operation if the wind blows more than thirty miles per hour. Commissioner <br />Hotter confirmed with Mr. Hall that they have had only one complaint filed against them <br />in the last seven years regarding dust control.
