Commissioner White said that "fugitive dust" is difficult or impossible to control and <br />asked what the company will do to mitigate the problem. Mr. Hall said that most of the <br />dust is because of the trucks and the speed limit they observe during high wind <br />occurrences. Commissioner White said that he wants to hear from individual citizens <br />regarding the matter. (Activated at 00:52:02) <br />La Plata County Assistant Attorney Adam Smith noted that the Southern Ute Tribe <br />would be drafting their own regulations regarding air quality control and, when done, will <br />supersede the State's permit. <br />Ms. Halverson said that their company will be applying for a State permit and when the <br />Southern Ute Tribe finalizes their regulations then their company will apply for a permit <br />from them as well. (Activated at 00:54:25) <br />Ms. Halverson explained that they will be applying for permits for both a concrete and <br />asphalt plant separately. She said that they must meet State regulations and there are <br />agents who will check on their compliance. (Activated at 00:56:47) <br />Commissioner White expressed concern regarding the operation hours of batch plants, <br />especially during the spring/summer months. Ms. Halverson said their company had <br />applied for a permit. Mr. Hall said that it was unlikely they would pursue the construction <br />of a batch plant simply as a matter of competition. He said that, currently, competitors <br />are able to supply concrete and asphalt at earlier hours in the day. The Conditions <br />stated in the staff report limits the hours they can operate. Commissioner White said he <br />understood why they were applying, but also needed to take into consideration the <br />concerns and impacts on the surrounding neighbors. (Activated at 00:58:03) <br />Deborah Caswell, a resident of Durango and neighbor to the gravel pit, said that her <br />concern was regarding the compliance and enforcement period between the time of the <br />State permit and the Tribal permit. She also expressed concern for bicycles and <br />motorcycles that use the proposed truck route to drive through the valley and <br />questioned their safety if more truck trips and traffic were added to the road. She also <br />noted that the added 15 days request for operation would most likely be on Saturdays in <br />June, July and August. She said that would mean the neighborhood wouldn't get a <br />break on the weekends from the traffic. She said she was concerned about the level of <br />noise. She asked the Commissioners to consider that this could be a residential area in <br />the future. She also wanted to know how this would affect the water flow in the river and <br />the amount of water needed by fish. (Activated at 01:02:01) <br />Delvin Gregg, owner of Gregg Flying Service in the Animas Airpark, expressed his <br />concerns regarding the proposed new activity at the gravel pit. He said that he has been <br />in operation at the Airpark for 35 years. He said that while permitting and dust control <br />has improved over the years, there is still dust created by the activity of mining the <br />gravel pit. He said, the prevailing wind isn't out of the north, but rather the southwest. <br />Mr. Gregg said that at times there is dust that he can see, but it comes and goes too <br />quickly for him to call State agents to investigate. He said that dust builds up on the <br />airplanes in his hanger. He said that, as a part his business, he has engines open when, -ho <br />P.O.
