"La Plata Electric Association, Inc. has no objections to the proposed project, provided that all <br />structures meet or exceed the minimum clearances to power line facilities as set forth in the current <br />edition of The National Electrical Safety Code, and also provided that no structures are located on <br />any LPEA easements, underneath any overhead power lines or on top of arty underground power <br />lines. " <br />San Juan Basin Health <br />Comments were received by email on May 19, 2010: <br />"San Juan Basin Health Department (The Department) has examined the application information for <br />the above mentioned project and has the following comments: <br />On-Site Wastewater System (OSWS) Requirements:: <br />o According to Department OSWS Regulations Section 3.1: <br />o "... The owner of arty structure where people live, work, or congregate shall insure that the <br />structure contains adequate convenient, sanitary toilet and on-site wastewater systems in good <br />working order... " <br />o The plan suggests applicant intends to use portable toilets for the duration of the project <br />(Spring, 2010 - Fall, 2014). <br />o A conditional OSWS Permit must be obtained from the Department for the multi year <br />"temporary use" ofportable toilets. <br />Air. <br />o Applicant must adhere to conditions of the FRCP submitted to the CDPHE. <br />o Proposed controls (compaction of stockpiles, water spray, etc) must be implemented for <br />stockpiles, overburden, and raw materials piles in order to minimize dust and emissions. <br />Waste Management. <br />o Solid waste must be disposed of properly at a licensed facility. <br />Stormwater: <br />o Best Management Practices (BMPs) must be implemented in order to prevent exposed soils and <br />sediment from potentially migrating off-site and into the waters of the State. <br />o Final reclamation should be implemented as soon as possible to stabilize disturbed soils. <br />o The Department emphasizes that the SWMP be updated kept on-site, and made available for <br />operation staff as well as inspectors. <br />Other: <br />o A noxious weed program should be implemented according to state and county regulations to <br />prevent the invasion of noxious weeds. <br />The Department approves of the proposal, in accordance with agency comments above ". <br />Southern Ute Indian Tribe <br />Comments were received by mail on July 22, 2010: <br />See attached comments <br />Project No. 2010-0055 <br />Animas Glacier Gravel Class Il <br />Page 16 of 21 <br />EA/I'H <br />V,Je21'13E1iJ'iche Collstruiction A 1fi ':, <br />P.O.
