wells will be required to generate the flow rate and volume required for this project if the current
wells are not capable of sustaining that level of production.
The wells are located in a non-critical water area, meaning that there is unappropriated water
available; however as noted on the permit it is possible that in the future this area may be subject to
administration in the priority system should the area become water critical and it is recommended that
a water court decree be obtained for the well. In the future, if mining is ever desired below the water
table, the pit will either have to be lined or a well permit obtained for the structure.
The Division of Water Resources has no objection to the proposed Land Use Permit with the included
described water uses, so long as the wells to be used are permitted for the necessary water uses and
pumping rates.
If the applicant intends to divert water from the Animas River, water is currently available for
appropriation.
