The first and probably most significant issue has to do with dust and the mitigation thereof. The <br />proposal talks about water being used to control dust as well as keeping vehicle speeds down to <br />control dust and no fugitive dust is allowed to leave the property boundaries. What are the <br />ramifications if dust does become an issue and how will that be addressed? Who oversees the <br />operation in order to require some sort of mitigation take place? Ifstrong winds come from the SW <br />pushing dust toward the airport, does the airport have the ability to ask that operations cease? <br />The other typical issue with construction near an airport is the height of construction. With no <br />elevations being shown on the plan contours it is tough to tell how the site sits in relation to the <br />airport's elevation. As the Federal Aviation Administration (FAA) has ultimate authority with regards <br />to height and airspace around airports per Federal Aviation Regulation Part 77 Objects Affecting <br />Navigable Airspace, please make sure all of the appropriate forms are filed with the FAA to ensure the <br />safety of the users of the Animas Airpark. " <br />Colorado Division of Reclamation, Minine, and Safety <br />Comments were received by mail on May 18, 2010: <br />"The proposed excavation and processing activities will need to be under a DRMS reclamation <br />permit. WCA (proponent) will need to apply for and obtain a regular 112C permit. " <br />Colorado Division of Water Resources <br />Comments were received by email on November 30,2010: <br />"Pursuant to State Engineer Memorandum to County Planning Directors dated March 4, 2005 and <br />cover Memorandum from Dick Wolfe, Director, dated March 16, 2005, the proposed project is not a <br />subdivision of land as defined in C. R. S. 30-28-101(10)(a). Therefore these comments are based on a <br />cursory review, and comments should be considered to be informal. <br />The applicants are requesting a Class II Land Use Permit from La Plata Countyfor use as a gravel <br />mining and processing area. The subject area is approximately 121 acres located near the section <br />corner of Sec. 12U& 13, R10W, T34N, and Sec. 7U & 18, R9W, T34N, N.M.P.M., near the southwest <br />corner of the Animas Air Park The proposed mining operations will not expose groundwater. Well <br />053789-F will be used as a source of water for the assumed purposes of product washing, dust <br />control, and other mining production related activities. Pumped water is to be stored in a holding <br />pond. <br />The new narrative describes the water demand of mining as being 65 gpm. The permitted maximum <br />flow rate of well 053789-F is 25 gpm with an annual maximum withdrawal of 20 acre-feet. Well <br />permit no. 149839 is also proposed as a possible source of water; it is currently permitted as a <br />domestic well with a maximum flow rate of 15 gpm and a maximum annual withdrawal of 1.5 acre- <br />feet. This well will have to be repermitted before used for the intended purposes. Also, if the project <br />will consume water at the rate of 65 gpm, 24 hours a day, this equates to 102.3 acre feet per year. The <br />current proposed wells do not have the required permitting to use this amount of water.
