Please indicate on the map the proposed post mine land use (rangeland) that will be <br />created on each of the delineated mining phases. <br />6.4.7 EXHIBIT G - Water Information <br />21.) Please explain how offsite areas will be protected from erosion and sedimentation during <br />the mining operation. Will any stormwater berms or structures be used or constructed to slow <br />stormwater? <br />22.) Will any water be needed for dust control or road maintenance during mining? If so, please <br />provide an estimate of the amount needed per day of the operation and the source of the water <br />to be used. <br />23.) Please indicate if a stormwater permit will be obtained from the Colorado Department of <br />Health and Environment. <br />6.4.12 EXHIBIT L - Reclamation Costs <br />24.) Based on your answers to the items raised in this review, the Division will conduct a <br />Financial Warranty estimate for the site. <br />6.4.13 EXHIBIT M - Other Permits and Licenses <br />25.) Please contact the Colorado Department of Health and Environment; it is likely a <br />Stormwater permit is needed for this operation. <br />6.4.19 EXHIBITS- Permanent Man-Made Structures <br />26.) The Exhibit C; Mining Plan Map indicates there is a gate along at the entrance to the mine <br />site. Given this, the Division assumes there are fences potentially around the property adjacent <br />to some if not all of the mining phases. The Division considers the gate and any fences a <br />Permanent Man-Made Structure. In accordance with Rule 6.4.19, when mining operations <br />could adversely affect the stability of any significant, valuable and permanent man-made <br />structure located within 200 feet of the affected area, the applicant may either: <br />a) Provide a notarized agreement between the applicant and the person(s) having an <br />interest in the structure, that the applicant is to provide compensation for any damage <br />to the structure; or <br />b) Where such an agreement cannot be reached, the applicant shall provide an <br />appropriate engineering evaluation that demonstrates that such structure shall not be <br />damaged by activities occurring at the mining operation. <br />Page 4 of 5
