Please provide evidence (certified letter to structure owners) that a notarized agreement <br />between the structure owners and the applicant was pursued or, in lieu of reaching these <br />agreements, please submit engineering evaluations for the identified structures. <br />Publication and Notices <br />27.) The Division received a copy of the publication and notice receipts. One of the recipient's <br />names was illegible. A copy of this receipt is enclosed for your review. Please indicate who this <br />notice was sent to and why. <br />28.) It appears the notice was sent to the following individuals; Dorothy J. Rodgers and Delma <br />Rodgers. These individuals are not identified in Exhibit 0. Please indicate who these individuals <br />are and why they were sent a notice. <br />29.) According to Exhibit 0; A Loy Rodgers and Tony Rodgers own subsurface rights of the <br />property. However, it does not appear they were sent a notice. Please provide evidence these <br />individuals were given a copy of the required notice. Or, indicate why they were not included in <br />notification. If these individuals need to be notified in accordance with Rule 1.6.2 (1) (e), please <br />provide them a copy of the notice and submit evidence when these individuals were notified, <br />and they will be given an additional 20 days to comment on the application from the date they <br />were notified. <br />Other Issues <br />30.) The Division received comments from the Colorado Division of Water Resources and the <br />Colorado Historical Society. These letters are enclosed for your review. <br />This concludes the Division's preliminary adequacy review of this application. Please remember <br />that the decision date for this application is June 29th, 2011. As previously mentioned if you are <br />unable to provide satisfactory responses to any inadequacies prior to this date, it will be your <br />responsibility to request an extension of time to allow for continued review of this <br />application. If there are still unresolved issues when the decision date arrives and no extension <br />has been requested, the application will be denied.
