Decree of the Water Court <br />Case No. 03CW8, Water Div. 2 <br />Transit Mix of Pueblo, Inc., et al. <br />Page 3 <br />respectively. <br />8. In Civil Action No. 8135, Pueblo County District Court, in 1903, the point of diversion <br />of 1.47 cfs of priority 27 and 0.41 cfs of priority 36 was transferred to the Bessemer Ditch. Those <br />water rights are not involved in or affected by this case. <br />9. Wells were permitted and constructed in 1932 and in the 1950's to provide a <br />supplemental water supply to about 100 acres of land irrigated by the then-owners, first the <br />Hudspeth family, and later Certified Concrete Co., Inc. Those wells were all decreed in Case No. <br />W-3374, in Water Division 2. In that case, Certified Concrete Co., Inc., also agreed to stop <br />irrigating 24 acres with the wells in a compensatory water program wherein Certified Concrete Co., <br />Inc., as a result of the reduction in irrigated acreage, was allowed to use some wells for industrial <br />purposes, and to expose ground water in a settling pond not to exceed 11 acres in size. <br />10. In Case No. 84CW 12, Valco, Inc., a successor company of Certified Concrete Co., <br />I <br />Inc., obtained an alternate point of diversion at the Pueblo Reservoir Dam. The intersection of the <br />Pueblo Dam axis and the Arkansas River is located at a point "...whence the Northeast corner of <br />Section 36, Township 20 South, Range 66 West of the 6th P.M., bears North 61* 21'20" East a <br />distance of 2511.05 feet." <br />11. On July 9, 2007, in Case No. 06CV1604, District Court, Pueblo County, Continental <br />Materials Corporation obtained a decree quieting title to it in 1.03 cfs of priority 27, 0.29 cfs of <br />priority 36 and 0.4 cfs of priority 59, all of the Hamp-Bell Ditch. <br />12. On December 19, 2007, in Case No. 06CV1605, District Court, Pueblo County, <br />Continental Materials. Corporation obtained a decree quieting title to it in an additional 0.6 cfs of <br />priority 59 of the Hamp-Bell Ditch. For purposes of this decree, the term "Hamp-Bell Ditch rights" <br />15003 h/transit mix/decree 02-22-09
