Decree of the Water Court
Case No. 03CW8, Water Div. 2
Transit Mix of Pueblo, Inc., et a/.
Page 4
will refer only to the Applicants' ownership interest in 1.03 cfs of priority 27, 0.29 cfs of priority 36
and 1.0 cfs of priority 59.
13. In 1959, Margaret Wonnell conveyed 0.5 cfs of Priority 59 of the Hamp-Bell Ditch
to Ralph and Josephine Truxell. The ownership of the remaining 0.1 cfs of Priority 59 has not been
claimed by any party to this proceeding.
III. Historical use of Hamp-Bell Ditch Rights.
14. From diversion records, aerial photographs and other documents, it has been
determined that during the period from 1950 through 1970, the Applicants' Hamp-Bell Ditch rights
were used for irrigation purposes. The decree in Case No. 84CW 12, which changed the point of
diversion of the Applicants' Hamp-Bell Ditch rights, indicated that 91 acres of land had been
irrigated historically. However, Applicants, through examination of aerial photographs, have been
able to document only 67 acres of land historically irrigated by the Hamp-Bell Ditch during the 1950
- 1970 study period, although a 1937 aerial photograph depicts more irrigated acreage. A map
depicting these 67 acres is attached as Exhibit A.
15. Average annual historical diversions of the Hamp-Bell Ditch rights are as follows:
Priority 27, 256.54 acre feet; Priority 36, 65.24 acre feet, and 1.0 cfs of Priority 59, 46.23 acre feet.
In the future, the amount of water available for diversion in priority shall be calculated, as discussed
in Paragraph 16 below. Maximum diversions shall be as indicated on Table 1 on the following page.
In addition to monthly and annual maximum diversions, each water right shall be subject to
cumulative 21 year running maximum diversions as shown on Table 2:
15003 h/transit mix/decree 02-22-09
