<br />a <br />Decree of the Water Court <br />Case No. 03CW8, Water Div. 2 <br />Transit Mix of Pueblo, Inc., et al. <br />Page 2 <br />Ralph and Josephine Truxells' unopposed motion to intervene as opposers was granted on <br />September 5, 2003. The time for filing statements of opposition has expired, and no additional <br />motions to intervene have been filed. <br />4. Upon the motion of Transit Mix of Pueblo, Inc., the case was re-referred to the water <br />judge on October 6, 2006. <br />5. The land and water rights involved in this case are not located within a designated <br />basin. <br />6. The Applicants have entered into stipulations with all the opposers. The stipulations <br />have all been approved by the Court. This decree is consistent with all such stipulations. <br />II. History of Hamp-Bell Ditch water rights. <br />7.• The Hamp-Bell Ditch was decreed on March 23, 1896, in an original proceeding in <br />the District Court of Pueblo County, for the following appropriations for irrigation purposes: <br />Priority Number Amount (cfs) Appropriation Date <br />27 2.5 November 1870 <br />36 0.7 18781 <br />59 1.6 1888 <br />The claimants were George Bell and W. Francis Hamp. The decreed point of diversion was <br />"located on the right bank of the Arkansas River in the N.E. 1/4 of the N.E. 1/4 of Sec. 36. T. 20 <br />S., R. 66 W., at a point S. 38° 43'W. 1028.68 feet from the N.E. corner of said Section 36, in <br />Pueblo County, Colorado." The decree was silent as to the number of irrigable acres, but in their <br />statement of claim, Mr. Bell and Mr. Hamp claimed to have irrigated 225 acres and 75 acres, <br />1 -Priorities 36 and 59 are administered with appropriation dates of December 31, 1878 <br />and 1888, respectively. <br />15003 h/transit mix/decree 02-22-09
