CM0001757 <br />• <br />Page 3 <br />• No. 1 Dam Impoundment Technical Specifications (Specifications) and Construction <br />Drawings [Plans (Appendix F)] were developed to guide and control the Dam <br />construction operations. <br />The Plans and Specifications are included under separate cover to this report to facilitate the <br />regulatory review process. As Section 2.0 summarizes, based on the Dam's classification only <br />Plans and Specifications must be submitted to the Colorado Department of Water Resources <br />(DWR) and the Colorado Division of Minerals and Geology (DMG) for CMC to receive <br />approval to construct the No. 1 Dam. <br />2.0 REGULATORY OVERVIEW <br />2.1 Design Criteria <br />• <br />r? <br />Both the DWR and the DMG consider the Dam to be non jurisdictional because the Dam's <br />storage volume is already included within the design storage volume for another fully permitted <br />Dam (i.e., the Robinson Lake Dam). Both the DWR and DMG have indicated (i.e., summarized <br />in a DMG correspondence and DWR telephone call record provided in Appendix A) that the <br />Dam construction does not require a formal permit application with respect to dam safety and <br />dam construction regulations. Based on the Dam's non jurisdictional status, DWR has requested <br />that only a copy of the Plans and Specifications be submitted to the DWR, and for consistency <br />the DMG, for their review and approval to construct the Dam. <br />Although classified as a non jurisdictional dam, the Dam was designed to meet the Class IV <br />small dam design criteria specified in the DWR Office of the State Engineer's `Rules and <br />Regulations for Dam Safety and Dam Construction' (Rules), dated September 30, 1996. The <br />Rules specify a Class IV small dam will have a maximum embankment height of 20 feet (ft) and <br />a maximum storage capacity of 1,000 acre feet (AF). At the Dam's maximum storage elevation <br />of 10,894 ft Mean Sea Level (MSL), the Dam's embankment elevation and storage capacity are <br />20 ft and 286.5 AF, respectively. Section 4.2 discusses how the Dam's alignment and cross- <br />section were developed.
