The system is intended
to be operational prior to spring run-off in 2009. Final design of the system is currently being performed
with the following anticipated schedule for various design elements:
Earthworks Design Issue for Construction (IFC) June 10, 2008
Foundation andConcrete Design IFC July 11, 2008
Mechanical, Elec/Instr, Piping IFC July 2, 2008
It is the intention of Climax to apply for a building permit as soon as possible after the completion of the
Foundation and Concrete design drawings. The current life of the anticipated mining operation is
nominally 18 years, with the potential for future ongoing operations. The life of the Robinson Lake Pump
Station may extend beyond active mining operations, depending on water management and reclamation
needs. Construction is anticipated to take approximately 4 to 6 months to complete. The pipeline will be
constructed during the summer months in 2008 and 2009.
Property Ownership
The Climax Mine land holdings consist of 14,300 contiguous acres of owned patented mining claims, fee-
simple land, and land acquired through exchanges with the United States Forest Service (USFS). The
• Climax Mine property is illustrated on Figure 1, which also portrays topographic features of the site, with
forty foot contour intervals. As indicated on this Figure, the Climax property boundary extends into Eagle,
Lake, Park and Summit counties.
The White River, Arapaho, and San Isabel National Forest lands are adjacent to the Climax property and
are managed by the United States Forest Service (USFS). The Colorado Department of Transportation,
Clinton Ditch and Reservoir Company, the Eagle Park Reservoir Company, and the Copper Mountain Ski
area own other adjacent land. The Eagle Park Reservoir Company and the USFS, White River National
Forest are the only adjacent property owners within Eagle County.
3. PROPERTY RIGHTS. Affected Land is defined by the DRMS as the surface of an area where a mining
operation is being or will be conducted, which surface is disturbed as a result of such operation.
All areas external to the treatment system are covered by an active General Stormwater Permit for metal
mining operations (COR-040178) issued through the Colorado Department of Public Health and
6
