B. Information Required for Annual and Monthly Projections: The annual and monthly
projections will include the following information:
1) Depletions from Previous Pumping_ Subject to Paragraphs 16 and 27(D), the
depletions associated with previous pumping of the Pinneo Feedlot Wells, the
Uhlenhopp Well, and Headley Wells, and with Gravel Pit Nos. 1 and 2.
2) Projected Pinneo Feedlot Well Depletions: Initially, monthly pumping of the
Pinneo Feedlot Wells during the first year of the projection will be assumed to
equal the average monthly pumping over the previous two (2) years. Pumping of
the Pinneo Feedlot Wells will be assumed to cease after October of the first year
of the projection.
3) Recharge Accretions: The accretions resulting from Pinneo's previous (prior to
the current annual or monthly projection) recharge activities, including without
limitation any previous exercise of the Pinneo Surplus Credit Recycling
Exchanges, described in Paragraph 10(b)(2).
4) Additional Projected Recharge Accretions: Except as described in this paragraph
and Paragraphs 33(B)(5) and 33(B)(6) , the projection may project no additional
accretions from additional water diversions and deliveries to recharge facilities
available to Pinneo during the four-year projection period. The projection may
project deliveries to and resulting recharge accretions from the Booth Farm
Recharge Ponds from pumping under the Booth Farm Well Right as described in
Paragraph 8(B) Only in full compliance with the provisions of 28(C)(1).
5) Storage Releases under Jackson Lake Rights: The projection will assume a gross
delivery at the Jackson Lake Outlet Canal discharge to the South Platte River of
15 acre-feet per share under Jackson Lake Rights, which will be reduced by
transit loss and, if water available thereunder is to be delivered to the Booth Farm
Recharge Ponds, by any carrying charges assessed by UPBCC. The amount of
water so projected to be delivered under Jackson Lake Rights to the Booth Farm
Recharge Ponds will be multiplied by 0.60 to project the augmentation credit
available. The amount of water projected to be released under Jackson Lake
Rights for direct augmentation use shall be multiplied by 0.473, after reduction
for transit loss consistent with Paragraphs 10(A)(2)(c) and 28(B)(2), to project the
augmentation credit available. Projections of augmentation credits available
thereunder shall otherwise be consistent with Paragraph 28(B) . Nothing in this
Decree precludes the Jackson Lake Reservoir and Irrigation Company from
determining the actual yield of each Jackson Lake share in accordance with its
normal operating policies and procedures.
6) Storage Releases to Headley Recharge Project: The projection will assume that
deliveries of any Headley Recharge Project water that is remaining in storage in
Riverside Reservoir as of November 1 will continue to be delivered to the
Headley Recharge Project during the next year until the Headley Recharge Project
29 of 33
