registered professional engineer or other qualified person. In the event a flow meter <br />malfunctions, the amount of water pumped during the time of malfunction may be <br />estimated based on power records for the well, by calculating the acre-feet pumped <br />per kilowatt hour for the prior two (2) months of pumping and multiplying that <br />number times the kilowatt hours for the period the flow meter malfunctioned. A <br />malfunctioning flow meter shall be repaired or replaced within thirty (30) days of the <br />time the malfunction is discovered. If not repaired or replaced within such time <br />period, Pinneo shall cease use of the well until the malfunctioning flow meter is <br />repaired or replaced. In addition, Pinneo shall maintain all measuring devices <br />required for the administration of the plan for augmentation, including without <br />limitation the measuring devices associated with the Pinneo Feedlot Wells, Booth <br />Farm Well Right, Booth Farm Recharge Ponds, and Headley Recharge Project as <br />required by the decree entered in Case No. 90CW 189, provided that nothing <br />contained in this provision shall require or give Pinneo the right to maintain <br />measuring devices currently owned, operated or maintained by third parties. <br />31. State water administration officials shall administer this plan for augmentation in <br />accordance with the terms and conditions set forth in this decree. <br />32. Pinneo's previously adjudicated water rights and plan for augmentation identified in Case <br />No. 90CW 189 will continue to be operated pursuant to the decree in Case No. 90CW 189 <br />and will not be affected by this decree, except as expressly modified by this decree. <br />33. Depletion and Augmentation Water Supply Projections: <br />A. Depletion Projections and Augmentation Water Supply Projections: On or before <br />November 1 of each year Pinneo will make a four-year projection (for each month of <br />the four-year projection period beginning on November 1st of the current year) of the <br />projected depletions from the Pinneo Feedlot Wells, the Uhlenhopp Well or <br />augmented structures under the Headley Recharge Project, return flows from <br />replacement sources, and the projected supply of augmentation water for replacing <br />out-of-priority depletions and required return flow obligations. The purpose of the <br />projection is to demonstrate that Pinneo will have sufficient augmentation supplies to <br />replace all depletions and return flow obligations in each month of the entire four- <br />year projection period. Pumping will be assumed to cease after October 31St of the <br />first year of the projection. Likewise, records of water use associated with the <br />Headley Farm will be maintained. Because the power lines to the pumps and meters <br />for Headley Wells Nos. 3993-F, 5709-F and 10794-F, no longer exist, no pumping <br />will be projected; however, the recorded water use to date, which includes past <br />pumping since March 1974, will continue to be lagged to determine stream depletions <br />over the four-year projection. Gravel pit depletions associated with the combined <br />Gravel Pits 1&2 that continue to occur will also be lagged to the river. The projection <br />will be used to limit the pumping of the Pinneo Feedlot Wells, to assure that full <br />augmentation will occur during the projection period. The projection will be <br />provided to the Division Engineer. The opposers will receive the projection upon <br />written request and payment of reasonable duplicating costs. <br />28 of 33
