CLIMAX PRE-HEARING STATEMENT
AM-06 APPLICATION, PERMIT No. M-1977-493
MARCH 31, 2011
• Exhibit 70, 12/96 Titan Environmental No. 1 Dam Impoundment Design
Report; and
• Exhibit 71, 1/22/97 letter from Titan Environmental to Climax re No. 1
Dam Impoundment Design Summary.
b. Warren's Pump System (a/k/a 1 Dam Seepwater System):
Moving westward from 1 Dam, the Warren's Pump Station and associated Tim's Pond
collect 1 Dam seepage and surface runoff and convey the water to the Tenmile Creek
basin for treatment and release. Warren's Pump System was an upgrade to the previous
Robinson Pump Station system. Mr. Maly may testify about details and history of the 1
Dam seepage return systems, including Warren's Pump System. The following exhibits
discuss Warren's Pump Station, a/k/a 1 Dam Seepwater System Pump Station, or the
concept of replacing the historic Robinson Pump Station:
• Ex. 68, 4/1995 Titan Environmental Corporation Report Re: Eagle River
Valley Reclamation Scoping Document discusses a potential new system
for collecting seepage from 1 Dam. See Ex. 68 at CM0001643-1644;
• Ex. 87, 6/25/1996 ltr from Division to Climax re: 1-Dam Seep Water
Pump Station and Impoundment;
• Ex. 88, 7/18/96 memo to file from A. Sorenson of Division: re: 1-Dam
Seep Water Pump Station and Impoundment;
• Ex. 89, 3/7/97 ltr from Division to Climax re: Certification of No. 1 Dam
Seepwater System Pump Station and Return Pipeline; and
• Ex. 90, 8/20/981tr from Climax to Division re: Closure of Robinson Pump
Station - Climax Mine.
C. Robinson Lake and Dam. The next barrier to flow of
impacted water into the Eagle River Valley is Robinson Lake and its dam. Robinson
Lake holds mill process water and is the receptacle for some seep return water. As can be
seen in Exhibit 85, Robinson Lake was relatively full in August 1995 during Eagle Park
Reservoir reclamation. Exhibit 91 depicts the change in storage levels in Robinson Lake
in recent years. Water quality in the Robinson Lake area has improved over the years
because Climax began intercepting seepage through 1 Dam, and upgraded these systems
with Warren's Pump Station and Tim's Pond intercept system. Mr. Maly may also testify
about details of the Robinson Lake and Dam and how the 1 Dam seep collection system
works to protect water quality in Robinson Lake. Exhibits relevant to the Robinson Lake
and Dam include:
• Ex.74 7/16/10 Letter from State Dam Safety Engineer to Climax re:
Robinson Reservoir Dam; and
10
