CLIMAX PRE-HEARING STATEMENT <br />AM-06 APPLICATION, PERMIT NO. M-1977-493 <br />MARCH 31, 2011 <br />reservoirs. The Division has certified these facilities as EPFs and routinely inspects <br />them.23 The facilities in place are the result of systematic improvements to the water <br />handling system over the years, resulting in reductions in risk of impacted water. The <br />next two sub-sections describe the environmental protections in place at Climax that <br />protect Eagle Park and Clinton Gulch Reservoirs. <br />1. Eagle River Valley <br />Multiple facilities are located in the Eagle River drainage that protect water <br />quality in the drainage, including in Eagle Park Reservoir. Eagle Park Reservoir lies on <br />the western edge of the Climax property. (Of course, Eagle Park Reservoir is no longer <br />on Climax property; the land for the reservoir was sold to the Eagle Park Reservoir <br />Company in the 1998 Purchase Agreement.24) The photograph from August 31, 1995, <br />provided as Exhibit 85, depicts Eagle Park Reservoir (under reclamation) on the far left <br />(east) of the picture. The Robinson Lake Reservoir (process water reservoir) is to the <br />right (west) of Eagle Park Reservoir, and further to the right (west) beyond Robinson <br />Lake Reservoir that is No. 1 Dam and the now-reclaimed Robinson Pond Tailings <br />Storage Facility (TSF). Figures AM-06-T-01 and AM-06-T02 from the AM-06 <br />application also provide illustrative figures of the Climax Water Management System, <br />noting all pump stations and dams discussed below. 25 <br />As discussed above and reflected in the record, over time Climax has worked to <br />alter its water system to minimize risk of impacted water in the Eagle River Valley. <br />These efforts continue via various outstanding TRs: the list of EPFs below only <br />addresses environmental protections for the Eagle River Valley that are currently in <br />place. There are no anticipated changes to these EPFs related to the AM-06 application. <br />Moving from east to west, the EPFs for the Eagle River Drainage (and Eagle Park <br />Reservoir) are: <br />a. Robinson TSF and 1 Dam. The crest of 1 Dam forms the <br />divide between the Eagle River and Tenmile Creek Basins. The Robinson TSF has been <br />reclaimed and will not store tailings in the future. Waters that are tributary to Robinson <br />TSF are detained within the TSF or flow down the Tenmile Creek basin through the new <br />East Side Channel or 2 Dam Spillway; they do not reach the Eagle River basin. Mr. <br />Maly may testify about details of Robinson TSF and 1 Dam.
