CLIMAX PRE-HEARING STATEMENT <br />AM-06 APPLICATION, PERMIT NO. M-1977-493 <br />MARCH 31, 2011 <br />Ex.79 8/5/02 Sampling and Geochemical Analysis of Robinson Lake <br />Sediment and Basal Soils and Monitoring Well Water Samples prepared <br />by American Geological Services. <br />d. Robinson Lake Seepage Pump System. As discussed <br />above, Climax was contractually obligated to install a seep collection and return system <br />below Robinson Lake in its 1998 purchase agreement with the Eagle Park Reservoir <br />Company.26 This system is located near the toe of Robinson Dam and consists of a <br />concrete bedrock cutoff wall, a collection pond, and a pump system that conveys <br />collected seepage water over Robinson Dam and discharges into Robinson Lake. The <br />current capacity of the installed pumps is more than capable of handling any increase in <br />seepage that might occur. Mr. Maly may testify about the details of the Robinson Lake <br />Seepage Pump System. Exhibits discussing the water quality at Robinson Lake and the <br />capacity and design of the pump system include: <br />• Ex. 67 at CM0001602, 1604-1623, 11/20/1996 ltr from Climax to <br />Division Re: Final certification of construction of cutoff wall and <br />pumpback station below Robinson and accompanying materials; <br />• Ex. 67 at CM0001603, 12/20/1996 ltr from Division to Climax accepting <br />certification of wall and pumpstation; <br />• Ex. 67 at CM0001593, 1579-1592, 8/25/20001tr from Climax to Division <br />alerting Division to seepage upgrades and accompanying materials; <br />• Ex. 67 at CM0001599, 9/17/2001 ltr from Climax to Division with final <br />construction certification re: seep system upgrades; <br />• Ex. 67 at CM0001600-160, 8/6/01 S. Maly certification to Climax re: <br />final construction of seep system; and <br />• Ex. 92, 3/27/09 report by AMEC Earth & Environmental Inc., Climax <br />Molybdenum Company Robinson Lake Seepage and Stability Evaluation. <br />e. 4 Dam Seepage Collection and Pump Station. 4 Dam is <br />the Eagle Park Reservoir Dam. The 4 Dam Seepage Collection and Pump Station <br />collects seepage water at the toe of 4 Dam, conveys this water around the south side of <br />Eagle Park Reservoir, and discharges into Robinson Lake, thus preventing seepage from <br />Eagle Park Reservoir into the Eagle River. This system was certified by the Division as <br />an EPF, and subsequent improvements to the system have also been certified by the <br />Division.
