Knox <br />Division Engineer <br />RESPONSE OF DIVISION ENGINEER TO CONSULTATION WITH REFEREE PURSUANT TO <br />CRS 37-92-302(4) AS AMENDED <br />IN THE MATTER OF THE APPLICATION FOR WATER RIGHTS OF: <br />1985 GATELY LIVING TRUST, DANA RUSSELL GATELY, TRUSTEE <br />AND BONITA LEE GATELY, TRUSTEE <br />DATE OF APPLICATION: 12/12/96 <br />DATE OF FIELD INSPECTION: <br />DATE OF CONSULTATION WITH REFEREE: <br />r RESPONSE BY DIVISION ENGINEER TO CONSULTATION BY REFEREE <br />COMMENTS: <br />This application seeks to adjudicate an underground water right and plan for augmentation'for a gravel <br />mining operation on 9.9 acres near Gunnison, Colorado. The underground water right is referred to as <br />Seahorse Pond Well which is a gravel pit. Source of supply to this structure will be intercepted ground <br />water tributary to Tomichi Creek. The pond will have a 7.3 acre surface area and is anticipated to have a <br />30 foot depth. Location of the pond is within 100 lineal feet of Tomichi Creek; therefore, the impact to the <br />stream is considered instantaneous. <br />Depletions to the Tomichi Creek and-,-Gunnison River systems will accrue from pond evaporation (17.20 <br />AF), water used in gravel washing (0.22 AF), and water removed from the site in the form of moisture <br />content in the gravel (2.66 AF) for a total of 20.08 AF/yr. It is anticipated the mine will be in operation for <br />four. years. Upon completion of mining activity, the annual consumptive use will be limited to annual <br />evaporation losses of 17.20 AF. <br />To offset the depletion, applicant claims dry-up credits for irrigated ground under the Grifftng No. 1 Ditch. <br />i Applicant claims 6.0 acres as historically irrigated under the Griffin No. I Ditch and an additional 3.4 acres <br />that was sub-irrigated. It is appropriate to recognize only the amount actually served by the Ditch, or 6.0 <br />acres. Use of the Blaney-Criddle method for irrigated haylands at this elevation and geographic location <br />
