Memo to Wally Erickson 3 October 28, 2009 <br />Third Review of Access Road Construction File No. M-2006-069 <br />vegetation in the fill. Compaction must be in excess of 95 percent modified proctor. A geotechnical <br />engineer must oversee the work and provide written certification to DBMS of correct execution, <br />including meeting the compaction specification. <br />11. In the "As-Build Report " Sakura Engineering states the relation of the floodplain to the toe of the fill <br />slope can be field verified using EDMsurvey equipment and further states that drawings illustrating <br />the relationship could be prepared. This must be done as soon as possible. <br />12. Upon completion of construction of the road, if it is approved by DRMS, As-Built Drawings must be <br />submitted to DBMS. <br />In a submittal received October 21, 2009, Wildcat Mining states that items 2, 3, 4, 8, 9, and 10 from the list <br />have been completed. The work required under those items has not yet been inspected by DRMS. Items 6 <br />and 11 have not been addressed, and the certification required under item 10 has not been provided. <br />DRMS August 2, 2009 memo required Wildcat Mining to provide a clarifying statement including the <br />following elements: <br />1. The road as it is currently constructed is temporary and its removal is a requirement of the <br />reclamation plan. <br />2. If and when the Operator decides to rebuild the road to a permanent configuration, a modification to <br />the permit must be approved for the road prior to commencement of construction. <br />3.
