Memo to Wally Erickson 2 October 28, 2009 <br />Third Review of Access Road Construction File No. M-2006-069 <br />possesses sufficient information about construction activities to issue an engineer's certification that the fill <br />was placed and compacted in eight inch lifts, and if such a certification can be made, provide the written <br />certification. None of these have been provided. <br />DRMS August 2, 2009 memo asked: were the embedded posts installed as shown on the drawings; can the <br />on-site engineer provide a written certification? This has not been answered. <br />DRMS August 2, 2009 memo stated: "(t)he condition of the retaining timbers and cable, particularly the <br />extreme angle of a formerly upright timber that was embedded 14 feet into the fill, indicate substantial <br />movement of the fill slope since the time of construction. The "As-Build Report" describes mitigation <br />actions but does not provide an analysis of the cause or extent of the instability or the ability of the suggested <br />mitigation to prevent further movement. Such an analysis must be provided for DRMS review." This has <br />not been provided. <br />The following is an excerpt from DRMS August 2, 2009 memo: <br />Wildcat Mining must commit to executing the following list of recommendations contained in "As Build <br />Report" and provide a schedule for their completion. All activities must be confined to areas for which <br />Wildcat Mining has legal right to enter. <br />1. Tree planting to occur in 2010. Wildcat Mining must provide a tree planting plan for DRMS review <br />and approval to be executed if DBMS approves the road. <br />2. Place straw bales at the bottom of the slope along the intersection of the slope with chain link fence <br />to stop loose soil and rock from migrating into the wetlands. This must be done as soon as possible. <br />3. The rock that has moved into the wetlands must be broken up and removed by manpower, not <br />equipment. This must be done as soon as possible. <br />4. All silt fence needs to be repaired, and damaged straw bales be replaced. This must be done as soon <br />as possible. <br />5. The pipe culvert that was installed at station 5+00 needs to be cleaned of debris and a metal grating <br />installed on the upstream inlet of the pipe. The inlet structure shown in Sakura Engineering <br />drawings must be installed. This must be done as soon as possible. <br />6 Provide a sampling and analysis plan for the pond at the toe of the road fill for DAMS review. This <br />must be done as soon as possible. <br />7 Complete final grading, road base, drainage structure and bar ditch. These items may not commence <br />until approval from DRMS to proceed through issuance of a mined land reclamation permit that <br />includes the road. <br />8. The upside of the road at station 4+40 to 4+60 has loose trees on the top of the slope. They need to <br />be removed and the slope cleaned of loose rock. The vegetation/trees must be removed by hand not <br />powered equipment. This must be done as soon as possible. <br />9. The silt fence on the entrance road at station 0+00 needs to be repaired and waddles installed on the <br />west side of the silt fence. This must be done as soon as possible. <br />10. All cribbing must be inspected for loose cables and slipped notches. A report of the inspection must <br />be provided to DRMS. This must be done as soon as possible. If and when a mined land reclamation <br />permit that includes the road is issued, areas of concern must be re-excavated, repaired and new fill <br />placed in the excavated voids.
