Vegetation <br />13. Bowie wilt be responsible for controlling and eradicating noxious weed <br />infestations on all NFS project disturbance until final reclamation is accepted by <br />the Forest Service. Any herbicides used must be EPA approved and will be <br />applied at the recommended rates. <br />14. Reseeding will be completed using a certified weed free seed mixture as <br />approved by the Forest Service District specialist, <br />Land Use and Recreation <br />15. To avoid conflicts with hunter use in the area, mobilization or demobilization of <br />drilling equipment will not be allowed on Thursday, Friday, Saturday and Sunday <br />of the opening weekends of the muzzleloader season, the first big game rifle <br />season and the second big game rifle season. <br />Transportation <br />16. The access road to the pad will be gated at the intersection with the Hubbard <br />Creek Road. When 24-hour operations are no longer occurring, this gate will be <br />closed and locked to preclude public motorized access. <br />Hazardous Waste <br />17. The Operator shall take all reasonable precautions to prevent any dumping or <br />spilling of oil or hazardous material on national Forests System lands, and shall <br />take appropriate preventative measures to ensure that any spill of such oil or <br />hazardous materials shall be immediately-picked up and removed from National <br />Forest System lands. Used oil resulting from the servicing or repair of equipment <br />shall not be buried on national Forest System lands, and shall be removed and <br />disposed in a designated city, county, or State disposal site or recycling facilities. <br />18. The Licensee and/or their contractors will be responsible for containment and <br />remediation of any spills of fuels, oil, and other hazardous materials. Any spills <br />of fuels, oil, and other hazardous materials that must be reported to other <br />agencies must also be reported to the USFS immediately. Immediate <br />containment and clean-up will be required consistent with Bowie's Spill <br />Prevention, Control, and Countermeasures (SPCC) Plan. Any contaminated soil <br />will be removed from the Forest prior to reclamation. <br />19. All releases (unless the reportable spill quantity is less than 10 gallons) of any <br />substance to soil or water would be immediately reported to BLM and USFS <br />Compliance Officers. Containment of the spill will occur immediately, clean up of <br />a spill will occur within 3 days, or as soon as practicable and proof of cleanup <br />provided for the record. <br />20. Bowie must clean up and remove all drilling equipment, surplus materials <br />(cement, etc.), trash, garbage, flagging, vehicles and other such materials from <br />NFS lands. <br />21. Portable toilets must be provided for personnel working on the drill sites. <br />
