Corey Heaps <br />McClane Canyon Mining, LLC <br />February 15, 2011 Page 11 <br />44. Surface water control systems are depicted on Figure 2.2 -3. The Division has the following <br />comments regarding this map. <br />a. Three cross sections of the pond feature are provided at horizontal scales of 1" = 10' <br />and 1" = 30'. The 1" =200' plan view of the proposed sedimentation pond does not <br />provide sufficient detail for review. Please revise Figure 2.2 -3 to include a detailed plan <br />view of the proposed sedimentation pond at a scale of 1" = 30' or 1" = 10'. <br />b. On Section A -A', please label the outslope (h:v) of the pond embankment. <br />45. The requirements of 4.05.9(14), (15) and (17) regarding inspection of the impoundment do not <br />appear to have been addressed in the application. Please provide commitments in the <br />application regarding inspection and certified inspection reports for construction of the <br />sedimentation pond, and quarterly inspections, in accordance with these sections. <br />46. On revised page 2.05 -22, it is stated in Section 2.05.3(4)(a)(ii)(C) that the sediment in the pond <br />must be removed before the pond is 60% fall of sediment. Please revise this sentence to read <br />that the sediment will be removed before the sediment level reaches 60% of the pond's <br />maximum sediment level. <br />47 On revised page 2.05 -24, there is a discussion concerning sediment control at drill pads. <br />However, there do not appear to be Sedcad designs showing that the sediment control <br />structures will function properly. Please provide such Sedcad designs or show where in the <br />permit these designs can be found. Also, please reference the location of the designs in the text. <br />48. Please state in an appropriate permit text section if the sediment pond is a class A, B or C <br />structure, as defined in Technical Release No. 60, "Earth Dams and Reservoirs ". <br />Rule 2.05.3(5) Operation Plan — Permit Area- Topsoil <br />49. MCM is proposing to strip all topsoil to an average depth of 20 inches in advance of <br />disturbance and stockpile it as shown on Table 1 in Appendix T. In reference to McClane <br />Canyon Mine Reclamation. Plan on page 2.05 -39, halfway down the page, it mentions during <br />contemporaneous reclamation efforts that both topsoil and cover material are to be temporarily <br />stockpiled to the south of the coal mine waste pile. According to Rule 2.05.3(5), a map of any <br />proposed storage structures shall accompany the narrative. Please amend Figure 2.2 -2 to show <br />where these temporary top soil and cover materials will be temporarily stored. <br />50. The fifth paragraph on page 2.0526 states that the proposed topsoil stockpile will have a <br />maximum vertical height of 50 feet, with side slopes constructed at 2.5h:1 v. However, Figure <br />2.2 -2 shows 2.0h:ly for the side slopes. Please review and revise as necessary for consistency. <br />51. In the first sentence of the last paragraph on page 2.05 -26, the word "cited" is used where the <br />word "sited" or "situated" may be intended. Please review and revise as appropriate. <br />
