EXHIBIT H
Naturally occurring wildlife in the affected area was not
plentiful particularly prior to the commencement of the operation
including the water operations on the Headley lands . Species
present include primarily bird life, rodents , and rattlesnakes .
However , the presence of water areas in connection with Mr .
Headley ' s water rights application and in the gravel pits has
increased the number of species present on the lands and has
provided habitat for many different species . The attachment
accompanying this Exhibit prepared by the Division of Wildlife
after an inspection in July of 1976 indicates that the Division
of Wildlife is aware of the habitat conditions on the Headley
lands and is monitoring the activities on such lands in rela-
tion to their effect on the wildlife species present . The only
known rare , threatened, or endangered animal present in the
area around the affected lands is the Lesser Prairie Chicken ,
and no evidence of the presence of Lesser Prairie Chicken on
the affected land has been noted. There appear to be no rare ,
threatened, or endangered plants in the area . The existing
and proposed operations will have no substantial effect on
or provide temporary or permanent loss of food and habitat
• for wildlife in the area nor will there be any interference
with migratory routes . To date the mining activities have
not substantially affected the wildlife present in the area .
