• percolate back into the underground alluvium or will percolate <br /> off Applicant' s lands into the alluvium of the South Platte <br /> River . It is not anticipated that a National Pollutant Dis- <br /> charge Eliminations Systems permit will be necessary since <br /> there is no "point source" , as defined by the applicable law, <br /> and all water percolating off Applicant' s lands to the South <br /> Platte River will percolate from the underground reservoir <br /> or from Applicant ' s farming operations . <br /> Water necessary for reclamation phases of the mining <br /> operation will be applied as Applicant converts the land to <br /> irrigated agriculture . The decree sought by Applicant is <br /> for 2, 550 acre feet of underground storage , which should <br /> provide sufficient water even during periods of drought , <br /> except the most prolonged periods , in order to irrigate all <br /> of Applicant ' s 600 acres of irrigated land. At such time as <br /> the decree is issued granting Applicant water rights , a copy <br /> thereof will be appended to this Application. <br /> w <br />
