Re: Enforcement Issues at Mackey Mite (M=1984-0 13),and Bates-Hunter Mine (M-1990-041)
Dear Mr. Otten:
Following inspections conducted 6n,27 July 20t0 for the Mackey Mine and the Bates Hunter Mine in
Gilpin County, the Division of Reclamation, Mining & Safety (Division) sent'correspondence to you
documenting enforcement issues and required corrective actions at the two mines. The enforcement issues
and corrective actions were documented in' inspection reports sent to you 3 September 2010. The due dates
for corrective actions are approaching or have already passed, and the Division has not yet received
indication of compliance with any of the corrective actions,
The Division must receive the following by the. deadlines shown. or enforcement action will be taken:
Mackey Mine (M-1984-013
I) Corrective Action #1 in Inspection Report:. Provide evidence that the required sign at the mine entrance
has been installed (3 l May 2010). Provide an`updated map showing<the permit boundaries (31 Dec 2410).
2) Corrective Action #2 in Inspection Report. Provide•a plan for safeguarding the open adit portal (31 Dec
2010). The plan must specify that the adit safeguarding will be completed by 27 May 2011, the Friday
before Memorial Day.
3) Corrective Action #3 in Inspection Report: Provide outstanding Financial Warranty in the amount of -
$7,162 (31 Dec 2010).
4) Corrective Action #4 in Inspection Report: 'Provide evidence thatmining activity is occurring at the site.
or file a notice of Temporary Cessation accompanied by the $115 fee (31 Dec 2010).
5) Corrective Action #5 in Inspection Report:: Clean up.the refuse at the site"and provide evidence in the
form of photographs that the cleanup has been completed (27 May 2011).
