Page 5. <br />provide an updated Map 15 showing the new disturbance, and modify the bond <br />calculation pages as necessary. <br />NECC response: Permit page 2.05-46 has been revised to include narrative <br />discussion of the new disturbance at the rock dust bin cut area. Map 15 has not been <br />converted to digital format at this time. Figure 13a includes the cut area overlay <br />over the disturbed area raster image from Map 15 Surface Disturbance and <br />Postmining Land Use-East Portal. Bond calculations Exhibit 28 page 153 has <br />been modified. The cut area for the rock dust bins at the East Portal causes an <br />increase in the disturbed area of 0.94 acres as indicated on Figure 13a. The <br />estimated depth of topsoil to be removed is based on the SCS soil data included in <br />Exhibit 14 Soils Information. The soil in the area has been classified at the P3E - <br />Dargol-Fuera-Varner Complex. The typical topsoil layer for this soil type is 5 <br />inches thick with a subsoil of 23 inches over siltstone. Depth to bedrock ranges <br />from 20 to 40 inches. A visual inspection of the cut slope area indicates an <br />estimated 9 inches of topsoil. The actual topsoil and subsoil depth will be evaluated <br />at the time of construction. At 9 inches of topsoil, 1,140 cy will be relocated to <br />Topsoil Storage Pile #2. Subsoil at 23 inches results in 2,915 cy of subsoil to be <br />relocated and stored temporarily at the subsoil storage area west of topsoil storage <br />pile #2. Of the remaining 13,500 cy of material in the cut, 4400 cy will be utilized <br />for fill in rope slope surface facility and at the breaker building. The 9,050 cy of <br />bedrock material will be used on site for berms, outfalls and other civil work. <br />13. The cut volume stated on page 2.05-5a for the rock dust tank area (17,500 cy) <br />conflicts with the value used (13,013 cy) in the bond calculations on page EX. 28- <br />153. Please correct this discrepancy and resubmit materials as necessary. <br />NECC response: The volume of the cut area in the bond calculation has been <br />modified to 17,500 cy. Exhibit 28 pages 129 and 153 have been modified to reflect <br />this change. Three copies of each are included with this response. <br />14. The light use road as it approaches the C & W roundhouse leaves the mine surface <br />disturbance area, then starts again on the west side of the building. Please refer to <br />Map 11, 2008 version for a correct depiction of the road network in this area. Map <br />11 Sheet 1 should be corrected in this area to only show mine roads where they <br />exist within the boundaries of the surface disturbance area as shown on Map 11 <br />Sheet 3. It may be beneficial to include the surface disturbance boundary on <br />Map 11 Sheet 1. Additionally, the surface disturbance boundary appears <br />incorrect at the RDA. Please review and correct as necessary. <br />NECC response: The surface disturbance area and light use roads have been <br />corrected on Map 11- New Elk Mine Site Plan East Portal Sheet 1- Roads, Slope <br />Track, and Cut Areas. The surface disturbance boundary is now indicated on all <br />sheets.
