3.1.6 Water-General Requirements: • (1) Hydrology and Water Quality: Ground water is discussed in Exhibit "U'- Ground Water Information. As proposed, the mining and reclamation plans will not adversely affect surface water hydrology or surface and ground water quality. As discussed, the Operator will implement its Spill Prevention, Containment and Countermeasures Plan and Stormwater Management Plan for the Bettger Pit. The Operator will also revise its Stormwater Discharge Permit as needed. • (a) Compliance with applicable Colorado water laws and regulations governing injury to water rights: Operator will comply with Colorado water laws and regulations governing injury to existing water rights. Water rights utilized for the amended Bettger Pit will be those held by HRLP. (b) Compliance with applicable federal and Colorado water quality laws and regulations, including statewide water quality standards and site-specific classifications and standards adopted by the Water Quality Control Commission: The Operator will comply with applicable Federal and Colorado water quality laws and regulations, including all the standards adopted by the State Water Quality Control Commission. (Please see items 3.1.5 (10), and (11) above.) (c) Compliance with applicable federal and Colorado dredge and fill requirements: The Operator will comply with all applicable federal and Colorado dredge and fill regulatory requirements. Where necessary, a Corp of Engineers 404 permit will be obtained prior to any dredging or filling of wetlands. At this time the Operator is not aware of any wetlands in the Bettger Pit expansion area that could be affected by the proposed expansion operation. The Operator will perform a wetlands study to determine if there are any wetlands that require mitigation. If any wetlands exist, a wetlands mitigation plan will be provided for approval. 18
