9. Please include cross-sections through the cut and fill area. If this cut
material is to be used for the Highway 12 alterations, describe how
the area proposed for disturbance will be returned to approximate
original contour. Also include maps and cross sections for this area
in the reclamation plan portion of the permit showing pre-mine and
post-mine contours.
NECC Response: Cross-sections are provided on Map 11 and Figure
14, page 2.05-46a. No material will be used for Highway 12
alterations.
DBMS Response: Response accepted.
10. Map 11 is noted as in transition as updated survey control is added
and new structures are added Please refer to Rule 1120 in particular
to the phrase legibly detail Currently Map 11 includes information at
a scale and or font that cannot be discerned Please refine this
important map to provide legible detail of all information being
presented.
NECC Response: Map 11 has been modified and improved.
DBMS Response: Response accepted, with the exceptions as noted
in this letter.
11. Please update Figure 2d on page 2.05-10b to indicate how surface
runoff will be routed to the ditch system shown on Map 13 of the
approved permit.
12. Page EX. 28-153, bond calculations, indicates 651 cubic yards of
topsoil will be removed from the area proposed for disturbance under
TR-54. The application form indicates a request to disturb.55 acres.
Although no map clearly shows the current disturbance and the
boundary of the proposed new disturbance, The Division estimates
that the new disturbance will result in an additional 1.3 acres of
disturbance, based on Map 15, Surface Disturbance. The information
as it currently exists does not provide enough detail on the area to be
disturbed, the amount of topsoil present, the type of topsoil, stripping
depths, presence of subsoil, removal, storage, and redistribution
depths. Please review pages 2.04-33 to 42 of the approved permit
application and add permit text narrative on page 2.05-46, provide
an updated Map 15 showing the new disturbance, and modify the
bond calculation pages as necessary.
