Please indicate the type of mulch to be used for reclamation and how many tons per <br />acre will be applied? <br />6.4.6 EXHIBIT F - Reclamation Plan Map <br />22.) The reclamation plan map is missing the following required elements: <br />a.) The name of the applicant needs to be displayed on the map. <br />b.) Please include a title "Reclamation Plan Map" on the map. <br />c.) This map must be signed by the registered land surveyor, professional <br />engineer or the qualified person who prepared it <br />6.4.12 EXHIBIT L - Reclamation Costs <br />23.) The submitted estimate does not include a cost to replace the overburden.stripped <br />during the mining process. Please provide an estimate for the volume in cubic yards of <br />overburden to be stripped during a single phase of the operation. Please indicate a cost <br />for replacing this overburden. <br />24.) The Exhibit indicates only 500 cubic yards of topsoil will need to be replaced for <br />reclamation. The reclamation plan indicates 1 to 6 inches of topsoil will be replaced over <br />the affected land. At this time the applicant indicated that mining may occur below the <br />ground water table. However, until that time, the Division will need to hold a financial <br />warranty to replace topsoil over an entire 10 acre phase. The Division will hold a cost for <br />replacing the topsoil at an average depth of 4 inches (approximately 5,400 cubic yards). <br />25.) The applicant indicates an open ground water pond may remain after the site is <br />reclaimed. If so, the Operator must eventually obtain a court approved augmentation <br />plan from the Office of the State Engineer. In the mean time, the Division is required to <br />set the financial warranty at a level which reflects the actual current cost of fulfilling the <br />conditions of the Reclamation Plan per Rule 4.2.1(1). Therefore, without an <br />augmentation plan in place the financial warranty must be set at an amount which <br />accounts for the exposed groundwater. The Division has identified several options for <br />determining the amount of the financial warranty. The Applicant must choose one of the <br />following options to be included in the financial warranty calculation: <br />1) Backfill all of the pits to two feet above the groundwater level. <br />a. If this option is chosen, please indicate the volume of material <br />necessary to backfill the pit with inert earthen material to cover the <br />4
