Also, please indicate <br />if enough material will be stockpiled on site to complete this activity. <br />2) Install a slurry wall or clay liner. <br />a. If this option is chosen, please indicate how deep the bedrock material <br />is at the site. <br />3) Provide the Division with documentation from SEO, which demonstrates that <br />the Applicant owns a sufficient amount of shares of water to cover the <br />evaporative losses from the exposed groundwater and the said shares have <br />been committed to the SEO should the financial warranty forfeited and the <br />permit revoked. <br />4) Commit to not exposing ground water until a court approved augmentation <br />plan is in place for this operation, or submitting/receiving approval from the <br />Division of an appropriate financial warranty to cover the cost of the exposed <br />ground water by one of the above three options listed above. <br />If the Applicant obtains an augmentation plan prior to final release, then the financial <br />warranty will be adjusted accordingly. <br />6.4.13 EXHIBIT M - Other Permits and Licenses <br />26.) The Division received a letter from the Colorado Division of Water Resources on <br />October 6, 2010. This letter is enclosed. Please clarify what specific permit will be <br />obtained from the Division of Water Resources? <br />6.4.14 EXHIBIT N - Source of Legal Right to Enter <br />27.) The applicant indicates they are a partner of White Ranch, a partnership which owns <br />the property where the mine will be located. The applicant provided a signed statement <br />indicating White Sand and Gravel has the right to enter the property. In accordance with <br />Rule 6.4.14 (Also ref. Rule 6.3.7), this signed statement must be acknowledged by a <br />Notary Public. Please submit an original signed notarized statement indicating the <br />Operator has the legal right to enter and mine. <br />Other Issues: <br />28.) The Division received a letter from the Colorado Historical Society on October 5, <br />2010 in regards to the proposed operation. Please see the attached letter and address their <br />concerns. <br />5
