(36) Several doc ented letters stating that the mine is always trying to short cut important
things. Right the you should have stayed on top of them. I worked for then i and I am the one
who put all of the farm ground back East of 2700 road. Whenever I would as i or tell them that
this isn't right, th y would state, "The State won't allow us or the State is us tam this to
dryland, or the S to has all of these rules and they won't permit us to do that. But, in fact, it
was Western Fue just doing us All wrong. And there wasn't enough expend a within your
department to w the difference. That's what's sad. Here we all were de g on you to
protect us and o properties and Western Fuels just ran with it because they new you knew less
than them. For ' stance, the people in charge of us didn't even know what a ll was, gated
pipe, center pivo furrows, and still don't. They are still labeling us as flood i rrigating and we
haven't flood irri ted for 39 years.
(37) Western Fue Is allowed their employees to remove dump truck after dun4 i truck and trailer
after trailer of to soil to do yards and gardens and many were actually side-I' 'ng jobs with our
soils. I fought for a year or more on this telling them that those soils do t belong to them-
I fought them to g them that they had the right to mine the coal but that they did not have the
rights to give o peoples topsoil away. This did not belong to them. It too much fighting and
complaining until finally they told them to stop taking the topsoil but they co d have the subsoil.
I told them that 1, Nas going to keep fighting, and finally after TW4 years, the stopped, at least
in Ii at of me. N ne of this is right, but they said the State allowed to them t do that and that
there was nothing wrong with this.
(38) When they p vided NRCS with irrigation facts, they told NRCS that the. r could not find
irrigators to work 7 days per week or change the siderolls twice a day. Brent pangler never
missed one day i seven years and he irrigated for me and the water was char ed by M&M
Custom Farming days per week, twice a day and sometime more depending n the situation
and in over 10 y , not ONE DAY WAS EVER MISSED. So, when NRCS did the irrigation
figures, they gav off two days per week. And then Western Fuels failed to m ntion that this was
a gravity fed syst so NRCS figured for time down for the pump repairs an mechanical
failure. All of a facts that were left provided a shortage of water. NRCS c an only work with
facts and data tha they are given and if those facts and data are correct then t6 end result is
WRONG. The u me for the Division decisions, if the facts aren't right, then a END RESULT
IS WRONGI Tlb .s caused irreparable damages to our property and to the lan when.
(39) It's been sin 1998 that the lease was signed and we still have absolutely not one bit of this
property put back into production!!! This is irreparable damages, also. The mine guaranteed that
we could follow ght behind them as I had done East of 2700 road and our would be put
right back and we would be out of production for only a short period of time. Iliat was 12 years
ago that we were old that and at 1000 ton per year and 125 dollars per ton, tht's a tremendous
loss.
(40) This is all in M6. Statements to no furrows, no gated pipe, flood ird IM:eM a
distortion of the 14cts and just as NRCS as said from the beginning, they are rs, if you
want to know the tam.
