(32) I am reque g that Dave Dearstyne also be at this meeting. It is docum ented in PR-06 that
this rocky Benc one material is equal -to or better than what we had and that . Dearstyne has
approved of this I spoke with Mr. Dearstyne, personally and he said that the BARX soils cannot
be duplicated, of be duplicated. These soils are prune for a reason. have the very best
physical and ch cal characteristics and that is why they are prime. He sal that it is possible to
create a suitable bsoil or make other soils prime over the years, but you not get equal to or
better than what had, The BARX soils in it's natural existence. This Ben h one material that
they have RAIS the salt content, RAISED the PH, Raised the rock fiagm is is not as good as
or better. Our B soils were down up to 72 inches deep and this Bench o material is not
going to replace that
(33) Also, in thi letter, Western Fuels GUARANTEED that we would have PERM*Revision
within 3045 dia-d a addressing all of our prime farmland and it's reclamation. I called Marcia
every week as " g for this Revision. She said, "They are working on it." Sh gave them
extension, after tension, after extension, after extension, after extension, d never once told us
when we called she had approved all of these extensions and then after a year, we were
SLAMMED wi them telling us that they were going to put our property an others into
DRYLAND. is and the State withheld all of this from us. This was the Beginning of PR-
06 and this was prime example of the STATE working hand and hand with Western Fuels to
Ruin us and cam v more irreparable damages until I started fighting back and finally got Mr.
Berry. I have h s of letters written to Marcia and Sandy and documen faxes and the
Governor, and USDA, and NRCS, and the newspaper,.and finally after ding a public
hearing which just to pacify us and nothing we said was enforced or u in our favor to help
us until I got Mr. Berry.
(34) The Walsh gineers do not understand either. They used ornamental p is for examples.
We do not raise o rnamental plants, we are real people with real crops. In the' footnotes, they
state that a highe salt content may not be good for some crops that we intend to grow. Alfalfa
roots may go do 20 feet as is documented in PR-06. They found our alfal mots down 20 or
better feet. Also orn is a deep rooted plant We have had roots from corn wn 12 feet. Most
are around 6 feet but we have found them deeper. W. Dearstyne states that t elevation
probably will no affect shallow rooted plats, but could affect deep rooted one . Another reason
WHY we need to be at that meeting that they would not allow us t0 attend. Again, fighting for
the mine instead f the landowner and our rights.
(35) Pr-W is ost All mine oriented. Enclosed are pictures and more do entation. The
mine took very ce pictures of all of our harvesting, but there has not been o e presented to the
State to show yo what we had before they mined. Instead they take Winter ictures or late fall
or early spring w ' e the ground is horrible and try and tell you guys that this s our place,
undeveloped ajait, ' documented. They make us dry our places up two years in idvance so that
when you look they say see, no crops, very little management, no water, whatelse has
been documenin PR-06 and instead of you checking it out, you approve o everything they
say. Mr. nnat the beginning is the one whoreally fought for us and kn what was right,
where is he nonow.
G 02ed GSTZ-S98-0G6 aejgjl RiTunwwo0 eiTjn4ew WdST :t? OTOZ TO %00
