Menlo to,PCPC <br />Re: SUP N0.1999-002 <br />September 13, 1999 <br />Page 2 <br />5,400 acres was obtained from'State and this lease has been executed (a `copy of the <br />property description and signature page, s attached to this review as Exhibit 4): <br />The applicant hasprovided documentation of intention to.purchase, from the <br />P,ocke Scanio interests, property that. would allow access for the plant and mining site. <br />to Lime Road:, This access point is considerably west of the original access point: A <br />letter dated August 16; 1999, from Alf Randall to Richard Hipwell indicates the newly <br />selected access point appears acceptable, subject to review of final design plans and <br />the final improvements to Lime Road (Exhibit 15). <br />LOCATION: <br />The property is located approximately 8 miles south of Pueblo and except for a small <br />portion is east of Interstate 25. The mining and processing activity will take place <br />initially easterly of the BNSF (former D&RG) Railroad right-of-way (approximately 1.5 <br />..miles east of 1-25):: The property is within portions of Sections 12, 13, 14, 18, 22,23'. <br />24, 25,:26,,27,. 28; T22S, R65W and within portions of Sections 7; 18, 19,_ and 30, <br />T22S, R64W of the 6th PM (Exhibits 5 <br />BACKGROUND <br />.....A portion. of the property was the subject of Special Use Permit No. 455 also for Mineral <br />..Extraction;: Processing and Cement Manufacturing. Special Use Permit `No. 455 was <br />approved by the Pueblo County Planning Commission on November 24 1981 with a <br />sinale condition requiring a one year review. The applicant, Mineral Reserves, Inc., <br />requested the special use permit upon approximately 3,900 acres of State Lands, which <br />correspond to the boundaries being requested by the current applicant, except that the <br />current applicant has extended the boundaries to include property northerly of the 1981 <br />.lands such that the permitted area would contain approximately 6,000.acres. In 1989, <br />the Planning Commission approved a one-year review of Special Use Permit No. 455 <br />vwith three conditions as follows: <br />-1. The applicant shall provide the Department of Planning and Development with a <br />copy, of any present or future local, State.or Federal permit. applications, permits, <br />amendments, or releases (e.g.; M.LRB, air quality, NPDES, Access, etc.) <br />associated with Special Use Permit No 455, within 30 days of their submittal or <br />approval. <br />2.% The applicant shall Provide to the Department of Planning and Development a <br />of the renewed lease within 60 days of this April 25, 1989 approval. <br />copy,.
