Pueblo County Planning Commission <br />FROM: Phil Shafer, Senior Planner <br />DATE: September 13, 1999 <br />SUBJECT: Special Use Permit No. 1999-002 <br />Rio Grande Portland Cement Corp., Owner/Applicant <br />Colorado State Land Board, Owner <br />Richard-Hipwell, Representative <br />PURPOSE: <br />Applicant requests a special use permit to allow for Mineral Extraction, Processing, and <br />Cement Manufacturing in an A-1'Agricultural (minimum 40 acres) Zone District upon <br />approximately 875 acres of privately. owned and leased property and 5,400 acres of <br />leased State Lands (Exhibit 1). The applicant's representative has updated the <br />original request to indicate that the activity will take place upon approximately 875 <br />acres of purchased lands and upon State Leased lands comprising 5,419 acres, but <br />mining and processing activity is anticipated. to take place only upon lands east of the <br />BN SF. (Denver & Rio Grande) railroad right-of-way for the foreseeable future (Exhibit <br />2). - <br />O\N'NERSHIP AND AUTHORIZATION TO ACT <br />A letter from Mr. Mark Davis, Minerals Director,. Board of Land Commissioners, dated:.: <br />4 April 29, 1998,.indicates the applicant, Rio Grande Portland Cement, has the consent <br />of. the Board of Land Commissioners to act on behalf of the Commission for this special <br />use application (Exhibit 3).. Rio Grande is lessee under mining lease GM 3299. The <br />State of Colorado owns both the surface and mineral estates granted through the USA <br />Colorado Enabling Act of 1876,.and subsequent in-lieu sections.
