6.4.15 Exhibit O - Owner(s) of Record of Affected Land (Surface Area) and Owners of Substance to be <br />Mined <br />18. The Applicant has indicated the mineral rights for the substance to be mined are severed. Please <br />provide the names of the other owners of the substance to be mined. <br />The response in Exhibit O intended to indicate that Elva Masters holds the surface property rights and all <br />mineral rights. There are no severed mineral rights. The original response to severed mineral rights in <br />the application should more appropriately have been marked not applicable. <br />6.4.19 Exhibit S - Permanent Man-made structures <br />19. The Applicant has stated there are no permanent man-made structures within 200 feet of the <br />affected area. Please revise Exhibit S to include County Road JJ. In addition, the Applicant shall <br />provide a notarized agreement between the Applicant and the person having an interest in the <br />structure, that the applicant is to provide compensation for any damage to the structure. <br />County Road JJ does lie within 200 feet of the east edge of the pit. A letter has been provided by <br />Washington County Commissioner Lea Ann Laybourn. It explains that Ms. Masters is aware and will be <br />responsible for any road damage that may occur to Washington County Road JJ during the mining <br />process. <br />I hope these responses adequately address the concerns from your preliminary adequacy review.
