As <br />shown within Exhibit E, Figure E.2 there are few remaining features exterior to the mine. <br />The entire permit area will be re-contoured to blend with surrounding topography. <br />PLEASE NOTE : the native topography yields slopes greater than the DRMS required <br />angle of repose. The post-mining plan is consistent with the intended land use. <br />14. Page 2, Fifth Paragraph "Exhibit D - Reclamation Plan (Rule 6.3.4)": "please provide <br />justification for removal of the sediment pond(s) during reclamation, or for the lack of <br />any stormwater or sediment controls". <br />RESPONSE: The approach to the post-mining treatment of the sedimentation ponds has <br />been revised. As per conversations with water treatment personnel, the retention of <br />the ponds would assure TSS retention thereby eliminating any inadvertent release to <br />the receiving Sneffels creek system. Since mining will have ceased, there is no reason to <br />believe that any mine-related release of permitted parameters (inclusive of TSS) would <br />occur. The retention of the ponds is an added assurance that no un-intended release <br />(i.e. from natural storm-water scour up-slope) would occur. The retention of the ponds <br />blends well with the post-mining topography and other retained features within the <br />permit boundaries. As such, please note -the ponds appear within Exhibit E, Map E.2 <br />Ruby Trust Reclamation Plan. Also please recognize that the location of the ponds post- <br />mining is slightly different from the location during mining. The ponds were moved <br />down-gradient in order to blend with the re-contoured slope in order to achieve the <br />desired angle of repose. <br />15. Page 2, Seventh Paragraph "Exhibit E - Mining and Reclamation Plan Map (Rule 6.3.5)" <br />: "Every map must include the date prepared and the signature of the qualified person <br />preparing the map... submit at least two maps instead of one". <br />RESPONSE : All previously provided Figures/conceptual drawings were signed and <br />dated. The revised Ruby Trust Mine Plan and Reclamation Plan were created, reviewed <br />and signed by the engineering staff at Buckhorn Geotech. Copies of all revised <br />Figures/Conceptual drawings from the initial Amendment submittal are provided in <br />ATTACHMENT F (these include Figures CA through C.3). <br />16. Page 2, Eighth Paragraph : "there is a 12 ft x 12 ft feature .. that is not labeled.. please <br />clarify..". <br />RESPONSE : This feature is also a concrete pad located outside the mill door.
