Page 3, First Paragraph : "please provide a revised map with appropriate updates... <br />should include the pre-law roads.. sediment ponds and discharging pipe..". <br />RESPONSE : The initial amendment Exhibit map has been revised to develop TWO maps <br />as follows; Exhibit E, Map E.1 Ruby Trust Mine Plan - provides a schematic of the <br />mining-related components to the Ruby Trust site. The pre-law roads, sedimentation <br />ponds and outfall are noted within this Map. Exhibit E, Map E.2 Ruby Trust Reclamation <br />Plan - provides the post-mining topography of the Ruby Trust permit area. Cross <br />sections of the post-mining topography are provided in Exhibit E, Figure E.3 Ruby Trust <br />Reclamation Plan - Site Grading Plan Cross Sections (provided in ATTACHMENT E). <br />18. Page 3, Second Paragraph : "the reclamation must have post-mining topography...". <br />RESPONSE : As previously mentioned, the Exhibit Figures were amended to <br />accommodate DRMS requests. The enclosed Exhibit E, Map E.2 Ruby Trust Reclamation <br />Plan contains the post-mining contours. Cross sections of these post-mining contours <br />are provided within Exhibit E, Figure E.3 (provided in ATTACHMENT E). <br />19. Page 3, Other Items : "two agencies provided comments..." <br />RESPONSE: The June 2, 2010 letter from the Colorado State Historic Preservation Office <br />(CSHPO) indicates that the proposed work described within the amendment should not <br />adversely affect cultural resources, however the CSHPO office does not have a <br />comprehensive inventory of features in the area. Therefore, in compliance with the <br />State law - revised statute (24-80 part 13) if the Ruby Trust were to encounter any <br />potential cultural/historic artifacts -the CSHPO office will be immediately contacted <br />and all disturbance will cease until a proper cultural resource inventory can be <br />accomplished. <br />The May 24, 2010 letter from the Land Use Department/Ouray County (Mark <br />Castrodale) identifies the need for a building permit for the proposed snow shed roof to <br />house the external mill features. In response, an application has been obtained, and as <br />required by the permit - engineered drawings for the roof are underway. In compliance <br />with the County, the snow shed roof will be constructed in a manner to address <br />appropriate snow load and also meet the above slope aspect in order to 'shed' the snow <br />rather than collect it. A copy of the drawings and permit from the land use department <br />will be forwarded to DRMS once they are obtained. <br />20.
