during active mining will not encroach upon the pre-law roads, therefore there is no <br />need to expand the permit acreage. <br />11. Page 2, First Paragraph "Exhibit D - Reclamation Plan (Rule 6.3.4)" : "The same types... <br />context of dump materials placement, grading, drainage.. setback... please describe how <br />current and expected future waste rock dump configuration must be changed so that the <br />approved reclamation gradient of 3:1 maximum slope may be attained". <br />RESPONSE : As previously mentioned, the anticipated rate of materials production will <br />be actively managed in order to retain a minimal amount of on-site storage of ore and <br />waste rock. This has been achieved during historic Ruby Trust operations. Future <br />operations will be more actively managed since the Mount Sneffels Mining Company <br />has obtained an agreement with the County to lend materials for road-base, erosion <br />control and abatement of avalanche scour (refer to letter agreement provided in <br />ATTACHMENT B). In regards to the 'reclamation plan', the proposed post-mining plan <br />for the permit area is shown in Exhibit E, Map E.2. As demonstrated in the Site cross <br />sections (Figure E.3) the maximum allowable slope is the ceiling limit slope for the <br />materials used to re-contour the Site. Please note, the native topography well exceeds <br />this required slope. Based upon the drawings provided in Map E.2 and the cross sections <br />within Figure E.3; the amount of earthwork volume to 'cut' would be 4,700 cubic yards, <br />and 8,175 cubic yards to fill. <br />12. Page 2, Third Paragraph "Exhibit D - Reclamation Plan (Rule 6.3.4)": "The plan <br />proposes... Lockable steel doors may afford the minimum but sufficient closure, though if <br />the operator has another proposed method, please communicate it to this office". <br />RESPONSE : As recommended by DRMS, the post-mining plan for the Ruby Trust permit <br />area will include the use of lockable steel doors on the mine portals and the <br />underground mill area. As shown within Exhibit E, Map E.2; access to the portals and <br />mill area was retained and blended with the surrounding topography. <br />13. Page 2, Fourth Paragraph "Exhibit D - Reclamation Plan (Rule 6.3.4)": "The roofed <br />exterior milling area... However the milling equipment, both exterior and underground, <br />are not so clearly consistent with this post-mining land use..". <br />RESPONSE : The retention of the exterior mill features has been revised. All exterior <br />mill features will either be removed or moved inside the 'interior/underground mill <br />operation' area. Sufficient area exists underground to accommodate these features. <br />The upper mill area is well above communication with groundwater, therefore the ? <br />placement of these additional mill equipment pieces will not cause any indirect concern a <br />to the resource.
