WFC Response: <br />This Comment appears to relate to properties other than the Morgan Property <br />and as such, Ms. Turner has no standing to comment regarding these matters. <br />WFC notes that it does not believe there is any dispute extant between it and any <br />of the landowners mentioned in this Comment as to the reclamation plans <br />affecting their property. As this Comment may relate to the Morgan Property, <br />WFC has reached agreement with the Morgan family that they will supply E2 <br />shares of CCC water, or more as needed, to conduct reclamation on the Morgan <br />Property. See, Attachment 3 (letter agreement). WFC does not respond to the <br />characterization of the 1992 soil survey, which is in the permit record and which <br />speaks for itself. <br />Comment Nos. 14 and 15: <br />Comment 14: Page 2.04 3-8 "The majority of soils on the Morgan Property in <br />the permit area are prime farmland soils as determined by the NRCS in <br />2008. We are not going to keep going through this. First off the ACTUAL <br />Prime Farmland soils were determined as prime farmland soils by DEAN <br />Stindt in 1992 when he stated that BARX soils are prime farmland soils and <br />with an adequate and dependable water supply they could he classified as <br />prime farmland. They were disqualified for the small acreage that be was <br />examining on the EASTERN Part of 2700 road and South of BB Road on a <br />very small area just down from the office. HOWEVER, even in his letter he <br />stated BARX soils were prime farmland soils. There were numerous soil <br />samples done within the permit area in 1988, 1996, and 1998 which one <br />was done by Jim Irvine and was a Class 1 soil survey. Mel Staats sued WFC. <br />As a result of the lawsuit Lance and Ross both stated that there would never <br />be another drop of PRIME FARMLAND within the permit area. They then <br />started using anything and everything they could do to disqualify Prime <br />Soils. <br />Comment 15: 2.04.12. If there is a chance that there MAY BE Prime <br />farmland the applicant must contact the US Soil Conservation service before <br />the application is submitted. If at that time, the applicant can prove thee is <br />no prime farmland, then and only than can they get a negative determination <br />from the Division. If PRIME SOILS ARE INDICATED which BARX had <br />already been designated as a PRME SOIL, then further investigation is <br />required not only by the APPLICANT, but by the STATE. AND ONLY WITH <br />ABSOLUTE PROOF, ABSOLUTE PROOF CAN A NEGATIVE <br />DETERMINATION BE MADE!!!!! In 1988, prime SOILS were recognized. In <br />1992, PRIME soils were recognized, and in the Class 1 Soil Survey done by <br />Jim Irvine in 1998, it was conclusive that not only was there PRIME SOILS <br />but there was Alluvials and lots of PRIME FARMLAND within the permit <br />areas. BEFORE ANY APPLICATION IS APPROVED!
