Again, <br />the final reclamation standard of the Morgan Property has been agreed with the <br />Morgan family, and the extent and acreage subject to irrigation has been agreed. <br />See, Attachment 3 hereto (letter agreement). In light of this agreement, it is <br />difficult to determine the relevance of much of this Comment. WFC will not <br />respond to the personal attacks, profanity and inflammatory statements <br />contained in this Comment. <br />Comment No. 13: <br />Page 2.04 3-9 Ward Burbridge used to own San Miguel Power property and it <br />was irrigated and cropped with Ward Burbridges water. San Miguel Power <br />bought it from Ward Burbridge and Morgans leased it from San Miguel <br />Power and Used MORGANS water to irrigate it. It was also irrigated and <br />cropped. IT WAS NEVER DRYLAND AS STATED HERE. <br />"Although San Miguel Power does not have ditch rights, they are supplied <br />water by WFC from CALAMITY DRAW. What liars! This is a flat out he. <br />Calamity is riot even plumbed to the San Miguel Power property except for <br />maybe a little less than a quarter of it. They are liars. They use Bud <br />Bensons water without his permission as well as Garveys and Burbridges <br />and they want you to believe that this water comes out of the draw to irrigate <br />all of this property. IT DOES NOT! The documentation of the letter of 1992 <br />written by Dean Stindt and used by WFC continuously as well as by the <br />STATE to disqualify any of the Barx soils because it did not have a <br />dependable and ADEQUATE water supply. The reason Dean Stindt <br />disqualified the piece of Barx Soils on the Staat place is because the water <br />came out of Calamity and Dean felt at that time by talking with the irrigator <br />that this piece was not Prime soils on that piece of property because it was <br />Calamity Draw and the dependable and adequate WATER SUPPLY WAS <br />DESIGNATED AS THE CC DITCH AND SINCE THERE WERE NO SHARES <br />TO THAT PIECE, HE DISQUALIFIED IT. It's funny how they can take one <br />thing and use it for their benefit and on the next page take that same <br />information and totally contradict themselves.
