What this is saying Mr. Berry is that BARX DARVEY soils had bean identified <br />as being prime SOILS FROM day one, 1988 AND 1992. Now Barx soils were <br />known to be PRIME long before 1998 and WFC also had a soil survey from <br />1996 and 1988 that showed BARX soils on our property, so there was NO <br />REASON THAT A FULL INVESTIGATION BY THE STATE AS WELL AS NRCS <br />AND WPC SHOULD HAVE BEEN CONDUCTED AT THAT TIME. EVERYONE <br />KNEW BY 1998 EVEN THE STATE BECAUSE IT IS ALL AT THE COURT <br />HOUSE WHICH ALL OF YOU HAVE A COPY OF. AND WFC KNEW THAT <br />WE HAD BARX SOILS AND THEY KNEW THAT MR. MORGAN WAS THE <br />LARGEST SHARE HOLDER AND AS THEY SIGNED THE LEASE THEY <br />KNEW IT WAS ALL IN CROP LAND!!!! <br />Now again, we would all like to know how they got their permit renewed and <br />why hasn't the STATE put a total end to all of these lies and distortion of <br />facts and until they have a complete and accurate plan to be on this prime <br />farmland property, why are they still being allowed to mine this or any of it <br />because there is other prime soils and Alluvials???? How are you approving <br />their applications and how are you even allowing such a ridiculous permit <br />revision??? <br />WFC Response: <br />These Comments (referencing page 2.04.3 - 8 and Section 2.04.12) have been <br />grouped together because they both concern the issue of the 1998 <br />misclassification of the soils on the Morgan Property that was corrected in 2008 <br />through TR-57 and PR 05. <br />WFC incorporates by reference its response to Comment No. 6, above. In light <br />of the above-referenced permit revisions and WFC's agreement with the <br />Morgans to treat all their land as Prime Farmland Irrigated Cropland, it is difficult <br />to determine the relevance of these Comments to PR 06. However, for the sake <br />of accuracy in the record, WFC does not agree with the characterization of the <br />1988, 1992 and 1996 soil surveys as stated in the Comments. In fact, each of <br />these surveys of the Barx soil map unit at the New Horizon Mine was also <br />consistent with the negative determination as to the existence of Prime Farmland <br />Soils. In any event, those soil surveys are in the record and speak for <br />themselves. <br />Comment No. 16: <br />Page 2.04 3-10 "Prime farmland soils as determined by NRCS in 2008 " <br />Again a lie. Prime Farmland SOILS were determined in 1988 as well as 1992 <br />and 1998. PRIME FARMLAND SOILS WERE DETERMINED AS EARLY AS <br />1988.
