<br />Farmland and ALL of them knew it in 1998. <br />TR57 is illegal and a technical revision cannot be used for major changes. <br />In 2008 NRCS determined that Barx soils were prime soils. Again All lies. In 1992 Dean Stindt <br />states in his letter that BARX soils are prime soils in the State of COLORADO. <br />In 1988, 1996, and 1998 Barx soils were identified and classified as being prime soils in the State <br />of Colorado. <br />2.05.4(2)(d)-15 Water available from the Morgans will determine how much of these fields can <br />be restored to prime farmland." Again ALL OF THESE FIELDS ARE GOING TO BE <br />RESTORED TO THE PRIME FARMLAND THAT THEY WERE PRIOR TO THE MINE <br />ENTERING THE PROPERTIES. The law states that the MINE must LEASE or provide <br />ALTERNATIVE water to restore ALL lands back to as Good as or better than they were and All <br />water calculations will be determined by us because we were the ONLY HONEST PEOPLE IN <br />THIS ENTIRE LEASE AND TOLD EXACTLY WHAT WE HAD ALWAYS USED TO <br />IRRIGATE WITH AND THIS HAS BEEN IRRIGATED FOR MORE THAN 50 YEARS. And <br />this leasing and alternate water supply done before they entered this property. This is the law! <br />An adequate and dependable water supply for 8 out of 10 years and the reason why the laws are <br />stated this way is because SOME PLACES DO NOT HAVE AN IRRIGATION SYSTEM SO <br />AN ADEQUATE AND DEPENDABLE WATER SUPPLY IS SOMETIME RAINFALL AND <br />THAT IS WHY THEY DO NOT STIPULATE IRRIGATION!!!! A dependable and adequate <br />water SUPPLY one that is good 8 out of 10 years. It is NOT how many shares of water and it <br />is not something that the State or NRCS or the mine decides whether or not we have enough <br />water. This is a FEDERAL and STATE law that is already in place since 1977 that it is an <br />adequate and dependable water supply which is the CC Ditch that come out of the San Miguel <br />River. All of this has been taken out of context and distorted by everyone. The law states that <br />the availability and whether the person is a SHAREHOLDER in this adequate and dependable <br />water supply is the determination. NOT how many shares are used to irrigate with. Rainfall is <br />based by law on 26 inches and we have enough irrigation water to every field within the pewrmit <br />area to match that 26 inches of rainfall in ONE season of irrigating!!! <br />In 2008 the Eastern Portion of Prime farmland 512.6 acres has been backfilled with Bench one <br />suitable subsoil. This was not approved or agreed on by us nor has it been proven to be suitable <br />subsoil. The salt content has been raised and the higher salt content may not be suitable for all <br />of the crops that we raise. <br />These decisions were all made at the February 2008 meeting which we were not allowed to <br />attend and we were told by Marcia, Sandy, Mike Boulay, and Dan that NO DECISIONS <br />WOULD BE MADE WITHOUT US AND NONE WOULD BE MADE AT THIS <br />MEETING.! ! ! ! I HAVE all OF THAT ON tape!!! <br />The Walsh engineer firm used ornamental plant documentaton and at the bottom of the page of <br />their study, it states, "Higher salt content may not be suitable for all plants or types of crops that
