They raised the values to get there test to passs.
THE LAW SPECIFICALLY STATES THAT A SUBSTITUTE CAN BE USED ONLY IF IT IS
BETTER THAT WHAT WE HAD AND IT IS NOT.
2.05(2)(D)-13 Again, there needs to be proper identifications done of the lands and labeled
correctly. Cropland, Pastureland, Rangeland There is NO IRRIGATED anything We irrigated all
of our lands and all of our land is irrigated but the State as well as WFC must use the
terminology that is universal in the rules and regulations.
2.05.4(2)(d)-13 Again document "BEST soils in 1988, 1996, 1999 They have it documented, so
why were they allowed to mine prime soils like they did?>
2.05.4(2)(d)-4 Determined prime soils by NRCS in 2008. All lies. All of you have a letter dated
1992 from Dean Stindt stating that BARX soils are prime soils in COLORADO. And then prime
farmland must be PROVEN a negative determination BEYOND A DOUBT. Not one document,
but several documents withn a very intense investigation is what the law says and proven beyond
a doubt.
Federal and State laws do not allow false documentation and false statements, why are all of
these still being allowed? All of you know that these facts are untrue and what really has
happened here is WFC did not want prime farmland and has done everything possible to distort
what really is because they stole our top soil with intent and no one knows how to fix what they
have done.
2.05.4(2)(d)-14
The pre-mine soil survey by Jim Irvine and Intermountain Resources did not define any soil
within the permit boundary as prime farmland soil. ALL OF YOU KNOW THIS IS A LIE. It
states specifically in the soil survey that the BARX soils are prime and it also state that according
to the NATIONAL SOIL SURVEY HANDBOOK which is the guidelines that MUST be used as
a reference that it is ALL PRIME. Also in 1992, 1988. And 1996, BARX soils were identified
as being PRIME FARMLAND SOILS. Also NRCS was NEVER contacted and consulted or
asked from 1993 on!!!! In 1992 Dean Stindt identified the BARX soils as being prime soils in
the state of COLORADO. There was NEVER a PRIME FARMLAND INVESTIGATION
PERFORMED for this permit area and there MUST be SEVERAL documentations proving
beyond A doubt IN ORDER TO GET A NEGATIVE DETERMINATION AND IT MUST BE
AN INTENSIVE INVESTIGATION TO GET A NEGATIVE DETERMINATION! And that
determination must have MERIT and Facts backing any such decision.
"However in Feb 2008. We are not going to allow or accept this statement because the STATE
was called in 2007 while they were removing our prime soils and told then and so was WFC
asked Not to take our soils and Lance told Mike and Mr. Morgan that this is a communist state
and those who have give and those who don't take and WFC knew with FULL intention that this
was prime soils and after speaking with Jim Irvine the other day, Everyone on the mine Ross
Gubka, Todd LeFaye, and Lance were ALL told that they were going to be entering prime
