quarterly, beginning within seven days after completion of refuse pile area preparation construction. <br />Inspections will continue until the refuse pile has been graded, covered in accordance with 4.10.4(4), <br />topsoil has been distributed, and the area revegetated in accordance with the reclamation plan <br />(Section 8). <br />Inspections will include observation of seepage rates, review of slopes for indications of movement, <br />and such observations and tests as may be necessary to evaluate the potential hazard to human life <br />and property. Inspections will include review of preparation of new refuse pile development areas to <br />ensure that all colluvium, organic material, and topsoil have been removed and that proper <br />construction and maintenance are occurring in accordance with the intent of the design presented in <br />this TR 120. Copies of inspection reports will be maintained in West Elk Mine offices. <br />If any inspection discloses that a potential hazard exists, the Division will be promptly informed of <br />the finding and of the emergency procedures formulated for public protection and remedial action.
