7. In respect to committing to vegetating the overburden and topsoil stockpiles the operator will <br />commit to seeding the stockpile at a rate of 9 pounds live seed per acre to of western <br />wheatgrass. This will prevent the wind and stormwater erosion of the soil. This will aid the <br />operator to achieve compliance with the stormwater pennit and the Colorado Air Quality <br />Standards. <br />8. The revised section 6.4. (e)(i) follows: <br />Mining Plan <br />6.4.4 Exhibit (D) Mining Plan <br />Correction of this section follows: <br />6.4.4 (e) (i) <br />(i) The estimate of the periods of time, which is stated above of ten (10) years per phase, is a best <br />estimate at this time. Then it will take between 3 to 5 years to establish the reclaimed area back to <br />rangeland that may be considered for release by the Mined Land Reclamation Board of the Division of <br />Reclamation, Mining and Safety. The reclamation will be an ongoing process as soon as the first unit is <br />deemed mined-out, and the phasing of the mining and reclamation will follow a natural progression <br />with final reclamation as the ultimate goal. <br />This portion of the permit file has been revised and it is attached to this document. <br />9. Section 3.1.13 of the application has been revised to reflect the name change of the office to the <br />Division of Reclamation, Mining and Safety in lieu of the Division of Minerals and Geology. <br />This portion of the text is enclosed with this adequacy review letter for the Office Permit File <br />M-2010-004. <br />6.4.5 Exhibit E- Reclamation Plan <br />10. The applicant would like to clarify the access/haul road statement that is in the original permit <br />application. The road that bisects the permit area from the lower southwest portion to the <br />northeast portion is a ranch road that exists presently. The applicant's consultant in the course of <br />the permit preparation discovered that the road in question is actually a Huerfano County Road <br />that is not maintained. The road will be part of the reclamation plan. The applicant / operator has <br />coordinated with the Huerfano Board Of County Commissioners and their County Manager <br />John Galusha to construct and improve segments of the road and to have it become a <br />functioning County Road. This requires that the roads be left in place after mining as part of the <br />applicant/operators reclamation. Please see the attached signed statement by the Huerfano Board <br />of County Commissioners to confirm this clarification of the statement in Exhibit E- <br />Reclamation Plan. The landowner concurs with this agreement and they have no objections to <br />the county road.
