Thank you for the clarification. <br />Peter Hays <br />Environmental Protection Specialist <br />Division of Reclamation, Mining & Safety <br />The applicant fells that this issue has been resolved to all parties and considers this matter closed. If any <br />items of interest are discovered on site during the mining operation the operator / applicant will notify <br />the Division of Reclamation, Mining and Safety and the Colorado Historical Society. <br />4. The Division of Reclamation, Mining and Safety stated that the maps when not signed as per <br />rule 6.2.1(2), which is correct this was an oversight by the applicant's consultant. This situation <br />will be corrected with this submittal all drawings and maps will be signed by Joseph P. <br />Gagliano. <br />6.4.3 Exhibit C - Pre-Mining and Mining Plan Map(s) of affected Lands <br />5. The applicant's consultant mistakenly stated in the original submittal that there was a Colorado <br />Interstate Gas pipeline (C.I.G.) on this permit site. The subject property does not have any gas <br />pipeline present. Further, more no gas transmission lines of any kind are closer than 200 feet to <br />the affected lands. Base on this consultant knowledge. There is no evidence on any maps or on <br />the ground, plus the property owner was consulted and he said no C.I.G. line was on site or near <br />the property. <br />6. The Qwest Corporation underground telephone/communication line has been labeled on the <br />Exhibit C- Per-Mining and the Mining Plan Maps. Also, please see the Exhibit "S " Permanent <br />Manmade Structures Agreement Signed and Notarized by the Qwest Corporation. The <br />agreement is attached in this adequacy review reply. <br />6.4.4 Exhibit " D" - Mining Plan
